The number of justices on the Supreme Court is not set by the Constitution. Trump could decide to expand it to 15 justices - as long as he got the Senate to “advise and consent”. FDR was infamous for expanding and packing the court, IIRC. The Democrats are hoping they can block Kavanaugh beyond the elections where (they think) they will take over the Senate and then they can refuse to approve any Trump nominee until 202 when (they think) they will take the Presidency and then get their pick. The court can remain at eight justices forever if the Senate lets it.
