I agree. But do the people who wrote that law understand the distinction. Also this is about restaurants. I think most of their unused food would go into the category of already been on a plate.

Like it or not, bet a bunch if these leftovers end up in trash cans sitting on the sidewalks in front of the restaurant BUT the restaurants TECHNICALLY didn't throw the leftovers out right? /sarc - sort of

Homeless shelter food poisoning cases in 3, 2, 1...

Some years back the FDA forced a change in food can labels and decreed that the old ones were no good. Wife and I were Salvation Army volunteers and were tasked in going through all their charity food boxes and pull out the dated cans.

I suggested those cans be given to the homeless and was told no, just because of the reason you stated. What a waste!

Everybody here can probably tell this similar tale: Smith's grocery used to donate their day-old bakery goods to the local Senior Center. One old lady found a touch of mold on one of the pies and instead of just dumping it or mentioning it to the Supervisor, she went to Smith's and bellyached. Smith no longer sent ANY goods to the Center.
