Full title........Sen. Marco Rubio warns Trump a border emergency could embolden a future Dem president on climate change
A national emergency declaration by President Donald Trump over border security could wind up hurting Republicans, GOP Sen. Marco Rubio told CNBC on Wednesday.
The Florida Republican contended that Trump was elected on the promise of building a wall along the U.S.-Mexico border and the president has to “keep that promise.” But “we have to be careful about endorsing broad uses of executive power,” he added. “I’m not prepared to endorse that right now.”
Such a declaration would set a precedent, Rubio said. “If today, the national emergency is border security ... tomorrow the national emergency might be climate change.” Declaring a national emergency, which would certainly face legal hurdles, could give Trump the ability to use the military to build the wall instead of getting Congress to approve the funding for it.

Obama managed to implement most of his programs without Congressional vote or approval. He violated openly whatever laws he found inconvenient especially existing immigration and drug laws. A President has the power to implement his policies, despite Congressional opposition, via executive order and discretion when they feel strongly about an issue. In the case of a wall Trump is making the case that there is a political consensus in the country for border security and is cleverly isolating the Democrats. If a future Democratic President wants dramatic climate change measures(which will involve taxes, international agreements and economy contracting regulations), he will also need a political consensus to act if Congress does not legislate.
See if they bring a legal challenge now. Let their own pinko judges box them in.
