The border story would get absolutely no traction if Ginsburg were to retire or die. If one knows that to be imminent, then it makes sense to re-prioritize the issues. Not give up. But not keep a stalemate going.
If there is no news of Ginsburg then President Trump should absolutely not declare a national emergency, and continue the current fight.
