The end of the Masterpiece Cakeshop case comes with a whimper

(RNS) — Last week, to little notice, the Masterpiece Cakeshop case ended with a whimper. Nine months after the Supreme Court found that the Colorado Civil Rights Commission had acted prejudicially in upholding the complaint of a gay couple who were refused a wedding cake by baker Jack Phillips, the two sides agreed to stop fighting.

Specifically, the commission withdrew its proceedings against Phillips for discrimination and Phillips withdrew his case against the commission for harassment. Which is to say that Phillips can keep refusing to customize cakes that, as he put it, “celebrate events or express messages that conflict with my religious beliefs.”

As you’ll recall, the justices didn’t decide that Phillips has the right to say no. Writing for a 7-2 majority, Justice Anthony Kennedy declared that while “the religious and philosophical objections to gay marriage are protected views and in some instances protected forms of expression,” nevertheless “such objections do not allow business owners and other actors in the economy and in society to deny protected persons equal access to goods and services under a neutral and generally applicable public accommodations law.”

Regarding "Colorado Civil Rights Commission",

Beware of these Nazi conclaves in your state.

These commissions are appointed and not elected, and therefore, unaccountable!

Next up for Colorado under SB-181, another unaccountable commission to destroy all energy production in Colorado. Those contributing to conservative causes will go first.

I thought they were about to report that the Cakeshop had closed. Totally different in meaning compared to the text of the article.

I don’t see how he can stay in that town that has made a career of harassing him year after year. Orphaned by the City Fathers.
It may cost too much at this point, to move into another town and start over. I wish him the best. He appears to enjoy his work.

The Civil Rights Act was very specific as to which groups were ‘protected’ classes. Homosexuals are not protected, they are not a protected class.

Justice Kennedy was writing law from the bench because he was biased in favor of homosexuals as he had clerked for a homosexual judge.

From what I’ve read, the town where Jack’s business is located is very supportive of him and his values. It’s interloping leftists from other areas, and from out of state, which are attacking him.

If “it’s against their religion” then can they be forced to perform gay weddings?

You are correct- If I remember correctly, these gay plaintiffs tried 17 other bakeries and had to travel 3 hours to find one that WOULDN’T back them a cake.

And I had also heard that they flounced in all demanding and gaying all over to make their pointed demands clear...”We demand YOU bake us a really offensive gay wedding cake”

Nazis aren’t a ‘protected’ group; apparently fags are. The bake shop had no problem with fags as customers, their problem was in celebrating a ‘marriage’ by baking and decorating a wedding cake which the shop owners felt went against their beliefs (as well as the beliefs of all of mankind for over 5000 years).

I don’t know that anyone would have a problem with a Jewish baker refusing to decorate a cake with a swastika, on the other hand, refusing to sell a generic cake to someone the baker knew to be a Nazi—I don’t know.

The question comes down to can the state force a person to act against his religious beliefs in the course of doing business. Can a muslim baker be required to bake a cake declaring “Christ is King” or “Muhammed is a False Prophet”?

It’s not a true win, as long as the Commission can bring lawsuits against others on similar grounds, forcing our side to spend money to defend, while they have unlimited taxpayer money to attack with.

A true win would involve the abolition of the Commission, and holding the commissioners personally liable for frivolous lawsuits.

The final line shows where the authors are coming from. They’d be perfectly content if SCOTUS ruled that religion itself is unconstitutional.

Sounds like a win to me.

Both yes and no.

It is a win in that they now have to get off his back.

It now leaves people like me in the position to have to "prove" that our declining a commission is because of "sincerely held religious beliefs". The correct response should have been, "he has the right to decline any commission he wishes for any or no reason."

Let's say a family wants him to bake a cake celebrating that their three year old daughter won a beauty pageant. Now this is probably not something against his "sincerely held religious beliefs" but he might find kiddy beauty pageants as distasteful as I do.

Does he have the right to decline the commission?

What if the family is black?

I will take the win but as a small business owner who takes commissions it does not go far enough in protecting our right to say, "no".

You can come in my shop and buy anything off the shelf you wish, but I must reserve the right to decline any commission. If I can not, we have a problem.

Next up for Colorado under SB-181, another unaccountable commission to destroy all energy production in Colorado.

Enviro-nutters in New Mexico tried that during the current session of the legislature with a bill to prohibit fracking for four years while it was studied. But the bill went into the NM state senate waste bin when the chairman of the Senate finance committee, a Dem, pointed out that the oil and gas industry provides 45 percent of NM state government revenues and this year's oil boom will put over $1.5 billion into state coffers. BTW, in spite of that the Dems still want a tax increase in other areas.

The NM legislature adjourns for 2019 in less than 22 hours (noon Saturday). Best way to keep lib Dems from destroying everything is to limit their ability to do so. The framers of the 1912 NM constitution (old white men, of course) wisely kept the time the unpaid citizen legislature is allowed to be in session is 30 days in even numbered years and 60 days in odd numbered years.

Well, I’ve posted before that those 2 ass munchers...BYPASSED at least 20 cake shops within a 50 mile radius and traveled close to 80 miles just to “order a cake” from this ONE SPECIFIC BAKERY. I wish I could post that article but cant find it..

The article I read a year ago had 25 bakeries within a 50 mile radius which even specialized in weddings...and close to the 80 mile radius, they SPECIFICALLY ordered from the one bakery.

If I were the baker, i would sue those 2 faggots THEN the CO state for discrimination.
