That's simply not true. Confidential is classified information. There are three categories: Confidential, Secret, and Top Secret. Within those, there are also special designations, such as NOFORN, SCI, and other restrictive classifications.

Confidential doesn't mean some Twitter meme that all cutesy.

If a military SSgt, 1Lt, or civilian working for the Dept of Defense leaked a Confidential document to the media, the military folks would be court martialed, and the civilian employee fired and brought up on charges of Espionage.

If you consider the potential for damage to national security, for confidential information the risk is small. I’ve seen plenty of confidential documents in my time, and it’s all pretty tame stuff. It really only gets serious once you get to the secret level.

I’m not saying that confidentials shouldn’t be treated with proper respect. If nothing else, anyone who would release such information can be counted on to do the same with more critical information. He or she would become a target for foreign espionage.

I don’t believe Comey would ever be convicted on this charge if it was ever brought to trial. And for political reasons, an acquittal would be worse than never bringing charges at all.

I'm not sure 18 USC 1905 applies. The actors there are a narrowly defined group and does not include law enforcement.

That said, it's refresheing to see people trying to line up the allegations with criminal code. This cures so many misunderstandings, and also makes people engage with the criminal code.

You'll be shocked at how well protected government actors are, especially those in the law enforement aspect of society. It is not a crime for a party to a case to lie to a judge (false statements statute, 18 USC 1001), which removes false statements from the set of laws that might apply to those who lied to the FISA court.
