It is critically important that any charges are backed up with rock solid evidence. Weak cases based on vague technicalities (like the memo leak) won't work. This is a political minefield...the evidence must be so clear that the average low-information voter can understand what happened.

Exactly. And you can thank Rat Bastard Sessions and the GOP for the delay. The time to investigate the criminal Democrats was in 2017 but “AG” Rosenstein blocked that. When POTUS floated the idea of replacing the recused Sessions the GOP publicly threatened him. Given that, the GOP owns this ongoing coup every bit as much as the Democrats do.

It might seem obvious that compilations of unclassified items of information should not be classified. When an individual item of information is unclassified, then a decision has been made that this item of information does not need the special kind of protection prescribed for classified information and that the information does not need to be kept from an adversary for national security reasons. If individual items of information are not protected from an adversary, then an adversary can obtain and compile them. Consequently, it would seem that a compilation of items of unclassified information should not be classified when an adversary can independently prepare the same compilation. However, there are many instances where compilations of previously unclassified information have been classified.

That’s interesting. Thank you for digging that up.
My understanding has always been that the highest classification level of any individual item in a document determines the overall classification of the document itself, and that should logically apply to a “compilation” as well.
But I see now that there could be exceptions. Whether that applies to the Comey memos is impossible to say.
I have also always understood that one’s common sense and judgement based on experience should come into play when one sees information that seems like it should be classified, but isn’t. Put simply, one should err on the side of safety.
If the Comey memos really should have been classified, then Comey should have treated them as such, and certainly should never have released them publicly. But of course, he had an agenda to advance.
But, as I have said, I don’t think a conviction would be possible if Comey was indicted for leaking the memos, as much as I think he is guilty of a crime for doing so.
