The decision not to prosecute former FBI Director James Comey over his deliberate leaks to the media isn’t a sign of weakness or lack of will, but of the professionalism and well-reasoned restraint of President Trump’s Department of Justice.

Attorney General Bill Barr’s number one goal since taking the helm at the DOJ has been to restore the impartial and professional ethos that has characterized that agency for more than 200 years.

He is working diligently to cleanse it of the stain of politically driven vindictiveness that Obama-era officials created by grossly mishandling the Clinton email investigation, and then, even more egregiously, orchestrating the series of events that led to the Russiagate witch hunt.

ROBERT MUELLER'S RUSSIA INVESTIGATION BY THE NUMBERS

Before this “investigation of the investigators” is over, there will undoubtedly be many cases of misconduct that warrant criminal prosecution. Comey’s, however, was not one of them.

What Comey did -- release private memos made in the course of his employment as FBI director to politically damage the president of the United States, who had just fired him for unrelated misconduct -- was absolutely outrageous, and totally unbecoming of the leader of this country’s premier criminal investigatory agency. It speaks volumes about Comey’s corrupt character and further illustrates why both President Trump and then-Deputy Attorney General Rod Rosenstein concluded that Comey was no longer fit to serve in that role.

It doesn’t make sense to prosecute him for leaking a document that was not “classified” at the time he leaked it. The DOJ classified afterwards.

So, if they wanted to prosecute it would look as though they created an x-post-facto classification simply to prosecute him. That is kangaroo court crap—and any judge with any sense would toss it out on its behind.

There will be plenty to “get him” on in the coming months. I think its best not to start out with a loser of a case.

DOJ was formed in 1870 which makes it 149 years old, not “over 200 years” but hey, what do I know. It’s not like I’m a journalist or something.

Very interesting. I said the same thing as soon as the news of the decision not to prosecute Comey over this came out the other day.

Just a couple of important considerations:

1. Comey could only be prosecuted for leaking classified information to the media if the information he leaked was TRUE. The problem in this case is that proving that the information in his memos was true would likely require testimony from President Trump. That's never going to happen.

2. There's a legitimate question about whether those stupid self-directed memos were even official FBI documents anyway -- regardless of whether they're true or not. Comey didn't prepare them on behalf of his superiors, and wrote them to himself and gave them to the media apparently without sharing them with anyone internally at the DOJ.

I agree. But it’s frustrating since the events of “the coming months” ALWAYS seem to be “coming” and never, ever arrive.

How long are we going to have to wait to see these seditionists brought to justice? Until nature has rendered the matter irrelevant since they’ve all assumed room temperature on their own?

They’ve probably only scratched the surface of Comey’s corruption. Look at all the corrupt scoundrels Obama put in place.

Obama and his goons need to be tried and convicted then dealt with accordingly.

The point here is to point out Comey’s behavior, which goes directly to character, to highlight the manufacturing of the coup and to document the extent of the FBI collusion in ongoing attempts to coverup official malfeasance at top levelsof FBI and DOJ and to obstruct investigation into that malfeasance.

Prosecution can wait in more serious crimes by Comey. This first disclosure, while it is a prose table crime , is just one small crime in a series of much more serious crimes so the the leaking is more appropriately evidence documenting Comeys much more serious crimes. This case is so convoluted and complex, trying to prosecute on this would confuse the issue of exactly which crimes Comey committed and would be detrimental to the process of bringing the guilty to justice< p>

I disagree for this reason: even if they couldn’t “get him” (a conviction) they must begin indicting these people & force them to burn some wealth just as they did to all of Trump’s people.

AS I said before, I will believe it when I see it. Until proven different, I still maintain that there are at least two systems of justice. One for the peons and Republicans and one for the Elite Democrats. The time for talking is past. Now comes the demonstration.

Precisely.

This would have been and iffy prosecution and there are far more egregious indictments on the horizon.....Perpetrating a fraud on the FISA court topping the list.

DiGenova gets ahead of his ski’s sometimes but he basically knows the Federal prosecution game and his judgment along with his wife’s is generally spot on,

I would already be in prison if I had leaked classified government documents to the media. Just like the Navy guy who took pictures in his submarine? I am sure he had no intent to sell them to the Chinese. He just wanted to show his wife & kids where he worked. He went to prison.

I like Joe and his wife Victoria but they are WAY to fond of Bob Barr and feel he can do no wrong.

It is not about being vindictive. It is about fairness. It is about not having a 2-tiered justice system where poor black people go to ass pounding prison for having an ounce of crack but Hollywood starlets get off with warnings after being caught with powder cocaine multiple times.

I am livid about this. DiGenova is dead wrong. There is no reason they DOJ could not have waited until the investigation ran its course to decide whether or not to prosecute. Coming out the same day to say “Comey gets off start free” smacks of more biased corruption by the DOJ letting FBI people off scott free.

I am furious. This is BS BS BS BS BS BS!
