Well, that depends on the facts. If he had intercourse while she was out, THAT is rape. If he molested her digitally (as someone upthread stated), that’s sexual assault or molestation, not rape.
Words DO matter. We should use them precisely.
Re “Rape is not a punishment for getting drunk.”
In a tough, uncaring world, maybe it is, in the sense that you’ve got to look out for yourself a little bit, because the person next to you might not.
Of course, morally, it’s not an appropriate punishment, it’s a crime of opporutnity. A more suitable punishment for getting drunk is a vomiting hangover and a splitting headache. And a more suitable punishment for the rapist should be greater than a 3-month sentence. Unless, he too was so drunk he didn’t know what he was doing, which I don’t buy.

He is responsible for thinking that fact made it ok for him to stick his fingers and/or any other part of his body in her genitals.

Getting stupidly drunk without people to look after you is a bad idea but certainly not justification for what was done to her.
When I was a teenager some guy had sex with a girl I was friends with when she passed out at a party. Best friend and I beat the **cker within an inch of his life and told him that when the ambulance shows up you go right ahead and tell them why this happened. He didn’t but things were different back then.
Penetration while unable to give consent is rape. I’m not sure where you got your law degree, but you should ask for your money back.

Many many FReepers believe this started out as consensual. But her drunkeness caught up with her and she passed out AFTER giving consent to sex.
Rape has been legally defined in most jurisdictions to include penetration by something other than a penis, non-penetrating acts such as female on male rape or oral intercourse, and penetration of an orifice other than a vagina.
That’s the legal definition.
Morally? Consider it personally - and we are talking about penetration here. Still just sexual assault?
