The 11th Circuit Court of Appeals (Alabama, Florida and Georgia) currently has 12 active judges after the appointment of 3 already this term by President Trump; the Circuit is now tied 6 - 6 with R and D appointees; with 3 more vacancies to fill; each of which has a current nominee awaiting vetting and a vote.
The tie-breaking 13th judge will be under active consideration for a cloture vote this afternoon on the Senate floor with likely confirmation tomorrow; making in 7R to 6D.
Once the additional two vacancies are filled; an enduring 9R to 6D majority will be in place.
The 2nd Circuit Court of Appeals was just flipped to a majority R in the most recent Senate vote taken, on November 13th.
The onslaught is turning into a rout.
3:00 p.m.: Convene and proceed to executive session to resume consideration of the nomination of Robert J. Luck, of Florida, to be United States Circuit Judge for the Eleventh Circuit.
Nonsense. The R’s were always subject to Dem vetos because of the blue slip garbage. Trump admin isn’t playing this game (as I understand it) but prior to this it was all a farce anyways so who knows if it’s really flipped

Would LOVE to see the DC Court flipped. I am afraid they will never convict a Dem, no matter the overwhelming evidence of criminality.
Justice Robert J. Luck was appointed to the Florida Supreme Court by Governor
Ron DeSantis on January 14, 2019. He previously served on the Third District
Court of Appeal in Miami after his appointment there by Governor Rick Scott in
March 2017.
Earlier, Justice Luck served on the Eleventh Judicial Circuit Court of Florida from
September 2013 to March 2017. He presided in the Criminal, Civil, and Appellate
Divisions. Justice Luck, in his years as a trial court judge, tried seventy jury trials,
and heard dozens of appeals from the county court and municipal agencies. Justice
Luck was appointed to the circuit court in 2013 and was elected by the voters of
Miami-Dade County to retain his seat in 2016.

DC Circuit is currently 7D to 4R (two from Trump); but the Obama Appointees there are fairly young.
The only likely retiree in that circuit is Judith Rogers, age 80, a Clinton appointee who has figured prominently in many decisions.
A retirement there and approved nominee there from Trump would make it 6D to 5R. He would need a full second term and an at least one unexpected vacancy to flip the DC circuit.

Just a bit of quibbling... There are 12 authorized judgeships on the 11th Court of Appeals. There are no current vacancies but there are three announced “future” vacancies of judges who will take senior status. Mostly the future date is TBD and will be effective once their replacement is confirmed.
There are 6 DemocRAT appointees and 6 Republican appointees among the sitting judges. Of the two appointees to be confirmed this week, one will replace a Clinton appointee and one will replace a Republican appointee resulting in a 7 to 5 Republican appointee advantage.
Has the confirmation vote for Van Dyke in the Ninth been scheduled?
Quibble noted. And indeed, those ‘senior status’ announcements will become permanent, once the announced replacements are approved.
So yes; not vacancies per se; as each of the announced ‘senior status’ judges remain active until their replacement is confirmed.
This scoreboard has little meaning, especially with the Republican track record of nominating liberal judges. What is significant is that McConnell and Trump have abandoned the old Republican method for selecting a nominee which was following the recommendation of liberal organizations like the ABA or treating these appointments as political favors.
The new method is producing results based on judicial temperament, adherence to Constitutional originality, and judicial record. Screening by organizations like the Federalist Society is greatly reducing the likelihood of a surprise. The Democrats have applied a political litmus test for years and they have had a serious negative effect on this country. That situation is coming to an end.
Not that I can see. The next two nominations to the 9th including Van Dyke, are replacements of George H.W. Bush appointees; so no movement in the 16-13 D-R split, but just replacements with younger appointees.
Agree. Hence the panicked and rushed impeachment effort.
We are encouraged by the Constitutionalist bent of these newly appointed judges. Yet is the best we can hope for is slowing the progressive legal onslaught against our institutions? That stare decisis thing you know.
Currently, six circuits have a GOP edge, six circuits have a rat edge, and the 11th circuit is split. So when Luck is confirmed not only will it give the 11th a 7-6 edge, it will give the GOP a 7-6 edge for the OVERALL circuits.
Of course, that doesn’t mean a whole lot in real terms since a) the circuits don’t operate like legislative bodies where having a majority means having complete control, and b) we all know that there are liberal GOP judges.
But it will be a nice watershed moment for Trump.
Slight Correction.
Luck will give the GOP a 7-5 edge on the 11th, and a 7-6 edge for the overall circuits.
