I don’t believe there is anything written in the constitution saying a President under impeachment cannot nominate justices to the bench. Question will be whether McConnell, who has pushed through over 150 justices will capitulate to whiny Democrats.

She served her country by sitting on the highest court. Yes, she is a left wing activist judge which defied our impartial legal system as written by the founders. In saying that, it is time for RBG to go home and spend her remaining time on earth with family.

If RGB dies before election day 2020 and Trump does not nominate a replacement immediately, anti-Trump voter turnout could be very high. If a Dem is elected POTUS Trump could nominate somebody before the inauguration.

On the other hand, installing a new justice before the election makes McConnell look inconsistent WRT Merrick, and that could make undecided voters turn against the GOP (which the media would certainly repeat with a drum beat).

It might be smoother sailing for Trump if she survives until the election is over.

There really is no parallel with the Merrick situation.

That was a GOP senate exercising its prerogative in stalling on confirmation until a candidate they approved of would be presented to them. This would be confirming a candidate they approve of before the opportunity is lost.

What really matters is how voters would see it. Let’s bookmark our posts and, if RGB dies before the election, see what actually happens. Trump is winning at the present moment. RGB dying could shake things up.

That is the one situation we definitely don’t want.

Very possible, as I posted above. But we can't be sure that, if McC confirmed a replacement before the election, there would be no voter blowback either.

Although I definitely would like to replace RGB ASAP, I think it would be safer to do it after she left the court beyond the election. But timing is beyond my control.
