If the House doesn’t produce articles of impeachment for the Senate then the impeachment process hasn’t been completed and there is no impeachment.

Years? Well at least until the expiration of this Congress at the end of 2020. I’m not sure that they would still be valid after that if not moved over to the Senate.

Methinks the next House of Representatives in 2021 would have to start the process over. This assumes Dems are still in control, which I have my doubts.

Democrats thought impeachment was so urgent that they needed to pass it within a year of the elections where the actual voters get to decide for themselves whether to remove Trump from office but it’s not so urgent that they can’t sit on it for weeks while they continue their fishing expeditions.

She made a colossal blunder in making public demands on the Senate. Few things piss off a career politician more than having another politician outside their legislative body tell them how to do their job. And that sentiment is magnified about a thousand times for U.S. senators.

Mr. McConnell could and should declare the HOR guilty of Obstruction of Senate. Hold a vote making that official. Then IF Nasty Pelosi does send those bogus article to the Senate - DISMISS AND DENY THEM.

Listen to this Senator McConnell. Mete out some judicial punishment to these bazarre,dark,existential Demoncrat gangsters!!

So, legally speaking...what happens now if they choose to withhold the Articles they passed? Can Trump take them to court? Seems unlikely because of separation of powers. if the process of a trial hasn’t begun, Trump can’t take them to court for legislation they pass in the House.

But if they lose the House in November, can the House GOP vote to nullify the “shampeachment”?? I’d like to know what options there are from anyone who knows what the legal moves are which would be pursued.

 

I've read several times that no matter if Pelosi does or does not send the article to the Senate - it's a moot point. The House has voted. It's no longer in their department. It is now officially a Senate Procedure.

It's like calling the cops and filing charges on someone. You may later change your mind. You may wish to NOT press charges or NOT seek prosecution. Too bad. You no longer have that option or choice.

Pelosi knows this impeachment was a YUGE mistake. She's trying to walk it back. Too bad. She has no control of this process now. It's in the Senate's wheelhouse.

I don’t think Articles of Impeachment survive past the Congress that passed them. So, unless Pelosi delivers the Articles to the Senate in 2020, they expire.

Here’s my theory, and possibly the Dems didn’t think far enough down the road should impeachment pass.

The process is to assign “Managers” who are to be the ones to argue the reason behind impeachment to the Senate. What individual in their right mind, wants to be the one to argue what is essentially a shoddy process, in front of a deciding body where the argument is essentially dead on arrival? Maybe Pelosi CAN’T find anyone who wants to touch something this toxic.

The same sort of rules limit the House by specifying a new impeachment inquiry must wait a year after the last vote on articles.

I don’t know why people keep harping on this “take Congress to court” angle. Federal courts have no business getting involved in most disputes between different branches of government, and a sitting President shows real weakness when he pursues legal avenues instead of just standing up and acting like a leader by using the powers vested in him under the U.S. Constitution. Seeking an injunction in Federal court right now is like asking Judge Judy to please tell Nancy Pelosi to stop being mean.

You are so right.

We all know that Mitch and the Repukes in the Senate could not give a care about Trump. Whether he is impeached, removed or whatever.

But this is not about Trump. This entire impeachment fiasco is really a power struggle between Rats in the House and Repubs in the Senate.

And as such, Senate Republicans are rightly asserting their power and control to defeat democrats.

And the fact this benefits the President is really not a primary concern to them.
