That prosecutor hasn’t got good grasp of the law.
If they guy is trying to take the gun, it isn’t premeditated
to shoot him. It is a heat of the moment issue. How could
he have planned that?

I really doubt the charge is intended to stick. What I see is a media untruth blitz in support of more riots and the ‘violent right-wing’ lie, and charges to intimidate lawful firearm bearers. Invalidating only releases a minor that’s going to be acquitted anyway.
