Flynn has been targeted by the traitors running the US national security complex ever since he blew the whistle on Obama understating the ISIS threat.

He became their enemy then and remains so.

Well, they did not take the easy way out and reassign the case to another judge since Sullivan made himself a party to the matter. That is unprecedented in its own right within our courts (another “new standard”).

Did they restrict his “inquiry” or place limitations upon it or does he have carte blanche to continue the persecution of Flynn on his own?

Will be curious to see the analysis beyond the justifiable outrage we all have.

Where can I find the article? I don’t want to read twitter remarks. Where are people getting the information from about another judge being assigned? This is just crazy to post something like this - without the source....

Trump’s AGs have screwed over Flynn, and by association, Trump. By far Trump’s biggest mistakes were Sessions, Barr, and allowing Wray to stick around.

This is a perfectly normal and unexceptional application of the law governing writs of mandamus.

Fokker is not the same circumstance as the Flynn circumstances, and is as irrelevant to Flynn as the Stevens case was to Flynn.

Powell has spent a lot of time making political statements about the case, and apparently she has succeeded in making many people believe her political statements were legal arguments.

Powell’s ongoing public political statements about the case have been stupid from Flynn’s pov, but they have also been despicable because they have misled many, many people about what the case ia actually about.

Gateway Pundit is calling this a win for Flynn, because it is a refusal of mandamus, which Sullivan wanted, so he could pick another judge to continue Flynn’s trial. So the appeals court sent it back to Sullivan to CLOSE the case. With dispatch. Meaning asap.
Any legal beagles out there know if the above is correct?

When Flynn pled guilty it created a problem.

Once the guilty plea was entered the case was over except for sentencing. Only the judge and the defendant were left, meaning that there is/was no more prosecutor left to call off the case.

That's what Sullivan realized and it's why the en banc appeals panel agreed with him. They are following the law, as disagreeable as that is. Courts aren't going to give you a shortcut when you can get to your goal by following their rules.

There is a way to end this but Powell hasn't tried it. She can request a withdrawal of Flynn's guilty plea under Federal Rule of Criminal Procedure 32(e).

Flynn appears to be factually innocent as described in that rule and therefore qualified to have his guilty plea withdrawn. But the prosecutor can't do it. It's up to the judge, and at this point Powell hasn't asked him to.

Does anyone have a direct link to the opinion itself? I went to the DC circuit, and it seems that unlike the Supreme Court, they hide their opinions behind a paywall. PACER access only.
