I think Fedo969 would rather Giuliani finally show the judge the cards just for America

Nice to hear from you!

Yeah I still have my American passport. I am a permanent resident but I didn’t want to put my citizenship in jeopardy.

Citizenship is like marriage. You can’t take your vows to many people (unless you live in Utah?). It’s one or the other.

Here's the full details.

1) Ultimately, state legislatures control the electoral votes for their state (in Article II of Constitution, confirmed by SCOTUS when the 2000 Florida vote was contested). 2) #1 doesn't happen unless the state legislature feels the need to. In 2000 the Republican controlled Florida legislature got tired of lawsuit after lawsuit filed by Dims to make the votes be counted and recounted and recounted, each time with Bush winning. So the legislature threatened to end it by invoking their Article II privileges and just pick the electors' votes. The Dims contested it, it went to SCOTUS, SCOTUS rules the votes had been counted enough and for Gore to get over it (officially SCOTUS said the Florida AG and Governor had already certified the results). But in that opinion they stated that Article II sill has the clause saying it's ultimately up to the individual state legislatures to pick the EC votes if they want -- since the Florida legislature didn't step in the assumption is the certified count had declared Bush the winner and it's over -- Bush won.

3) If one of Trump's lawsuits in the various voter fraud close states goes to SCOTUS (and it will, cuz whoever loses at the lower court level won't be satisfied), I believe SCOTUS will at most say the evidence for fraud is profound but hard to prove in the brief period needed by January -- so it's up to the state legislatures. They'll be especially liable to say this since some of the Dim states have intentionally thrown in the contested ballots into the general population of ballots. (Thus it's impossible for SCOTUS to tell them to ignore the ballots that came in late or were "cured" or voted by dead folks, so SCOTUS will almost certainly say it's up to the legislature in those states.) All of the legislatures in the contested states are Republican majority in both houses. 4) So after all of the EC votes are counted, whether or not some have been designated by state legislatures, then we see if one person has a majority (270 or more). If nobody has a majority (because they either tie at 269 or perhaps one got 268 while one got 267 and a 3rd party person like Jorgenson got 3), then it would proceed to a Contingent Election under the 12th Amendment.

5) If it gets to that point, the House of Representatives would vote for the president with each state getting one vote (even relatively high population states like California and Texas get one vote each). Basically each state's representatives vote together, and whoever wins the vote in that state gets that state's single vote. (i.e. Alabama might vote 5 for Trump and 2 for Biden, thus Alabama's vote will be for Trump). So even though the Dims outnumber the Republicans in the House, the Republicans have more states in the House and the vote would probably go to Trump.

I bet Bill Clinton is crying over that lost cigar. ;)

The speculation and inaccurate information on this thread is astounding.

PA is very simple. State law says all valid ballots must be received by 8 o'clock. The Dem governor and Dem SOS announced that votes could be accepted after that. The PA Supreme Court allowed it. This is the basic appeal.

The claim to the Supreme Court by the pubs is that PA should follow the law. Alito has already ordered that the late votes be kept separate. A few weeks ago, the court had allowed a delay in the cutoff date 4-4, with Roberts siding with the liberals. This was an emergency ruling, that might be revised. Or there might be a novel appeal that can re-challenge the cut off date.

That's all there is to it.

Yes, historic and ugly, but also constitutional. ;-)

Bingo!

As Mitch McConnell stated, on the Senate floor, this morning....

Our institutions are actually built on this & POTUS is 100% right to weigh ALL of his LEGAL options.

May the lynch-pin holding up the rat facade be discovered and removed and then it all comes tumbling down.

You know, if Biden had ANY type of Presidential mettle at all, he would have refrained from the victory laps and said something like, “Slow down folks. Votes are still being counted. Let’s make sure the process is free and fair.” Instead, he just goes full throttle completely ignoring The Constitution.

This guy is so inappropriate for the job. I’m convinced he was chosen because he was willing to go along with the steal.

It is wiggling a little with the election. Last time I looked Trump would get 27 states with 2-3 ties. They would use the new congress not the current one.

You will never have to pay for a beer again in your life if that scenario become true!

I’ve wondered what the endgame could be since ordering a new election seems completely unlikely.

Whoever said a Trump presidency is dull?

Yes but there would be hell to pay if they went against a clear popular vote.

Thanks - I stand corrected.

But isn’t my point is still valid: Namely, that it would be the current Congress and Senate deciding this - in mid-to-late December?
