->Makes no mention of ballots.

“...except that, when required by law, such records and papers may be delivered to another officer of election and except that, if a State or the Commonwealth of Puerto Rico designates a custodian to retain and preserve these records and papers at a specified place, then such records and papers may be deposited with such custodian, and the duty to retain and preserve any record or paper so deposited shall devolve upon such custodian.”

-> Therein an auditor acts according to the state law. There is no mention that the law needs to be a federal law, and, in fact, it presumably will not be one.

“Any officer of election or custodian who willfully fails to comply with this section shall be fined not more than $1,000 or imprisoned not more than one year, or both.”

-> “Willfully” plainly means deliberately. Any accidental failure by an auditor due to an unforeseen circumstance or even merely a hardship of conducting the legally required audit plainly in no way constitutes “willfull.”

“Any person, whether or not an officer of election or custodian, who willfully steals, destroys, conceals, mutilates, or alters any record or paper required by section 20701 of this title to be retained and preserved shall be fined not more than $1,000 or imprisoned not more than one year, or both.”

-> The Justice Department’s assertion “Violators of either section can face fines of up to $1000 and imprisonment of up to one year for each violation” is misleadingly and threateningly ambiguous when it adds “for each violation,” a phrase that does not exist in the code, and which could falsely be interpreted as implying that the destruction of multiple records could result in multiple years’ sentence.

And where are the prosecutions for all those videotaped lapses that showed the need for the audit in the first place?

Open season on those at the DOJ is in order. Criminalizing investigation of the criminals running DOJ is s as declaration or war against the people.
We really should be finding out where these criminals live and where their kids go to school.

“organizers of election audits” would likely be classified as "custodians", and subject to the terms below.

If a state or local election authority designates some other individual or organization to take custody of the election records covered by Section 301, then the Civil Rights Act provides that the “duty to retain and preserve any record or paper so deposited shall devolve upon such custodian.” 52 U.S.C. § 20701.

Section 301 itself makes it a federal crime for “[a]ny officer of election” or “custodian” of election records to willfully fail to comply with the retention and preservation requirements. 52 U.S.C. § 20701. Second, Section 302 provides that any “person, whether or not an officer of election or custodian, who willfully steals, destroys, conceals, mutilates, or alters any record or paper” covered by Section 301’s retention and preservation requirement is subject to federal criminal penalties. Id. § 20702. Violators of either section can face fines of up to $1000 and imprisonment of up to one year for each violation.
