There are many questions about Potter's level of performance, training, practice, experience and assignment during her career. Theoretically the Department had no belief that she was substandard in any, because they did not discipline her or require corrective training.

Potter's record also indicates there is no reason to believe she had any animus or negative attitude toward anyone.

Therefore there is no reason to doubt that this incident was accidental with no intent to kill Wright.

Dersh takes the Legal implications from there.

Additionally, actually engaging in personal combat generally immediately cancels "the plan" and initiates "adapt to prevail or die".

Now how much did that Taser weigh, and what did the grip feel like?

Everyone keeps focusing on what side of the body the cop carries their taser. In fact all cops carry it opposite their pistol and that is not the cause of this mistake. It’s how you deploy the taser that caused this mistake. If you deploy your taser with your primary hand then it’s easy to make this mistake since it functions similar to a pistol. It is suggested cops be taught to deploy the taser from their support hand that way they reduce the potential for this mistake. And for everyone who suggests she should not have made a mistake while fighting with a criminal, maybe they can tell about their last fights after the age of forty and how everything went just as they planned.

fewer traffic stops——well, yeah, wouldn’t you think they would have adjusted their methods after the Somali dirtbag shot the gal in her pajamas, and got, I think, 4 years for it. This bizness of cops shooting unarmed people has got to taper off.
Don’t they tell us we can’t shoot people who are running away.
And remember the Guyer gal in Dallas who shot Big John while he was watching TV in his own apartment.
And the Houston reserve officer who shot the handcuffed guy while he was laying face down?
Shooting people in their own beds goes back to 1971 when ATF shot The guy with the 1847 replica black powder pistol.
And don’t forget the two hotshots who killed the Idaho rancher WHO THEY CALLED to help neutralize a car-hit bull.

The stupid runs deep in law enforcement-—too many hot dogs and not enough schooling about high powered machinery.

As a side note-—that 9mm cartridge that Potter layed on the kid carries 345 foot pounds of energy. That’s enough, if properly placed, to lift her chubby butt six feet in the air. Those of us who regularly use powerful machinery, tools, etc. know we have to point the stuff in a safe direction. From bulldozers to dynamite to guns to hammers you have to have your head out in the daylight. The trial didn’t establish where Potter had hers and crying and screeching is not corrective action?

This Republican only wants Justice where Justice is merited!

Her own superiors testified that even if she had purposely used deadly force .. it would have been Justified!

Ask Yourself .. if tasers had never been invented, what’s a cop to do in a similar, possibly dangerous situation?

Whistle and wave bye bye?

The guy was a criminal Thug, not following legal commands as Thugs never seem to do .. putting cops in a dangerous situation!

Yeah .. I feel for the officer and am Delighted that another career Thug is no longer breathing the same air as the rest of us!

after a jury convicted her Thursday on two counts of manslaughter.

Like in the Chauvin case, more than one conviction for manslaughter for one death. In the Chauvin case, he was (wrongfully) convicted of manslaughter AND murder!

609.20 MANSLAUGHTER IN THE FIRST DEGREE.

Whoever does any of the following is guilty of manslaughter in the first degree and may be sentenced to imprisonment for not more than 15 years or to payment of a fine of not more than $30,000, or both:

(1) intentionally causes the death of another person in the heat of passion provoked by such words or acts of another as would provoke a person of ordinary self-control under like circumstances, provided that the crying of a child does not constitute provocation;

(2) violates section 609.224 and causes the death of another or causes the death of another in committing or attempting to commit a misdemeanor or gross misdemeanor offense with such force and violence that death of or great bodily harm to any person was reasonably foreseeable, and murder in the first or second degree was not committed thereby;

(3) intentionally causes the death of another person because the actor is coerced by threats made by someone other than the actor’s coconspirator and which cause the actor reasonably to believe that the act performed by the actor is the only means of preventing imminent death to the actor or another;

(4) proximately causes the death of another, without intent to cause death by, directly or indirectly, unlawfully selling, giving away, bartering, delivering, exchanging, distributing, or administering a controlled substance classified in Schedule III, IV, or V; or

(5) causes the death of another in committing or attempting to commit a violation of section 609.377 (malicious punishment of a child), and murder in the first, second, or third degree is not committed thereby.

As used in this section, a “person of ordinary self-control” does not include a person under the influence of intoxicants or a controlled substance.

609.205 MANSLAUGHTER IN THE SECOND DEGREE.

A person who causes the death of another by any of the following means is guilty of manslaughter in the second degree and may be sentenced to imprisonment for not more than ten years or to payment of a fine of not more than $20,000, or both:

(1) by the person’s culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another; or

(2) by shooting another with a firearm or other dangerous weapon as a result of negligently believing the other to be a deer or other animal; or

(3) by setting a spring gun, pit fall, deadfall, snare, or other like dangerous weapon or device; or

(4) by negligently or intentionally permitting any animal, known by the person to have vicious propensities or to have caused great or substantial bodily harm in the past, to run uncontrolled off the owner’s premises, or negligently failing to keep it properly confined; or

(5) by committing or attempting to commit a violation of section 609.378 (neglect or endangerment of a child), and murder in the first, second, or third degree is not committed thereby.

If proven by a preponderance of the evidence, it shall be an affirmative defense to criminal liability under clause (4) that the victim provoked the animal to cause the victim’s death.

There is a veteran, off duty sheriff in Nebraska who shot an illegal alien who had a gun trained on his ex-wife’s head. The illegal alien survived being hit by two of the nine shots. My point is every situation, adrenaline and emotions run high. The left’s fallacy about aiming for the leg and winging is just that, a fallacy.

I can’t imagine being in that type of situation and making split second decisions. I don’t think I would be evaluating the weight or which side my weapons were on. Training would be helpful in these situations.

I’m of the kind that Potter had no business working in law enforcement. She strikes me as a “diversity hire” who was hired and promoted way beyond her capabilities.

One report I saw indicated that she worked behind a desk most of the time but was on the street that day with a rookie officer because she does TRAINING for that police department. WTF?

I recall hearing that the judge called the jurors “heroes.”

One way or another, they are, because _no matter what_ they would have done, if their identities are discovered, you can bet that the nuts will hound them.

She TRAINED people?

This sort of thing is what gives police departments bad reputations though most of them are fair and run properly.

Sorry but you're wrong, ... If you're enough of a Protected Class, and you have enough crooked Democrat Bureaucrats running interference for you, you can be a Kenneth Walker, and walk away from shooting a cop in the leg while the cop was executing a legal search warrant.

That said, I know what you mean, (I just HAD to sting you) but that problem IS rooted in Police misbehavior while Potters problem is not.

From what I understand the thug who inexplicably was out on the street after committing an armed robbery amongst other crimes, was trying to drive away putting the lives of fellow officers in danger who could have been run over. Right there she had the right to shoot the bastard. Her biggest mistake was admitting right away she meant to Taser him.

All the cops need to do is go on strike, REALLY strike for a day. When people see the anarchy that would break out, they will be begging for cops and the heads of any politician that bashes them. Look how the animals came out with the grab and go thefts just by defunding cops. Imagine NO cops.

I’ll take the “value added” of a truck driver over a cop, any day of the week.(I’m a manufacturer)

It cracks me up when they wonder why police couldn’t just shoot a weapon out of a perp’s hand. They actually believe that this can be done by the average police officer with a pistol.

I have actually seen this done on a video, by a sniper with a sniper rifle, prepared and at amazingly close range, on a guy with mental issues pointing a gun at his own head. The shot actually broke the gun and I think the person with the gun kept all their fingers. All involved agreed that it was an amazing and lucky shot.

So, if a doctor makes a serious/fatal mistake, should they be thrown in prison? That’s what malpractice and malpractice insurance is for. Without that, no one would want to be a doctor. After things like this happen, who would want to be a police officer in a dangerous setting?
