That exception makes the law useless. When Sandman was suing people were saying he was a public person because the lies people were saying about him made him one. Same with Kyle Rittenhouse. Both of them were literally unknowns prior to that yet the law is so backwards as to protect the major media's right to make stuff up about people like them.
