Vehicular homicide. Vehicular homicide is a class A felony. A conviction carries three to 20 years in prison and a maximum $20,000 in fines
They don’t want to bother with proving he’s sane or that his confession is valid in spite of being drunk at the time.
Because of previous DUI’s he may be looking at a mandatory minimum of 10 years.
Still, a slap on the wrist for first degree murder.
A 10 year slam dunk is better than an expensive gamble on 1st degree. And the judge might sentence him to the full 20.
As long as they don’t let him plea down...
He could get as little as 3 years or less, with a plea.
He confessed to premeditated murder.
He confessed while drunk and is a known nutcase. That confession could get tossed. That’s the gamble I was referring to.
The current charge puts him in ten years minimum because of his prior DUI’s. They won’t need to use his confession or any state of mind testimony. They’ve got vehicle forensics and a blood alcohol test which is all they need. Trial would be over in a day.
In a small county, a 1st Degree trial would bust their budget.
Guy should get life.
That’s all I’m saying.
Anything less is flipping the bird to him and his family.
