More complicated than that. Double jeopardy would apply because a verdict has been rendered

I feel bad for those families and their disappointment, but this guy did get life without parole and nobody is going to change the sentence.

IMO life without is worse than the DP.

manson was sentenced to death

commuted to life when death penalty repealed

then up for parole on a regular basis

denied of course

but from death penalty to up for parole

as long as he is alive anything can happen

It should have to be TWO people.
One should have to convince at least one other to have
veto power or else the term jury has no meaning.

Somehow, I don’t think the killer will be around for a full fifty years. There is still a lot of local anger about the shootings. Surviving spouses, family members, close friends will have a long time to think about all of it.
Someone may decide it will be up to them individually to
‘set the record straight’, ensuing collateral damages be damned.

the judge can make the final decision in this case.

In Florida, a death sentence requires unanimous jury decision. A judge may not unilaterally sentence a convict to death.

You may be right.

One of the Manson murderers, Leslie Van Houten, was approved for parole, but the governor blocked it. That was in liberal CA, Florida would probably be tougher.
