That’s the way I took it . who will make the determination whether or not there was a bias?
This will cheer everyone up.
If he was wrongly convicted, can he reenter the army and get all that back pay?
Is his discharge upgraded making him eligible for benefits?
Will he be welcomed to the VFW?
This DC judge has zero jurisdiction over a military court. He overstepped
He should have been executed long ago, now that he might get rank, money, and active duty back is a travesty.
Army Military Justice made their decision. A federal judge has no say in that matter.
Why did you write this?
“The judge ought not to have lied.”
Here’s what the judge did according to the article:
“The Army judge in his case failed to disclose a possible conflict of interest — that he had applied for a civilian position at the Justice Department while presiding over the court-martial”
I don’t understand why this grounds to dismiss the case.
But if a trial is not conducted properly then its verdict must be thrown out I suppose. It’s gotta be that way.
I don’t think a federal judge has jurisdiction in this case either. My understanding is that if a military person commits a civilian crime like robbery etc they can be tried either in civilian court or military tribunal. But Bergdahl was tried for desertion and I guess collaborating with the enemy. All military crimes.
A Senior Judge has no jurisdiction unless both parties agree to allow a Senior Judge to sit on a case.
