Eleanor Elizabeth Cruz, Ted’s mother, was born in Wilmington, Delaware. His father was born in Cuba and was not a US citizen at the time of Cruz’s birth. But his mother, Eleanor, was an American, born in Delaware, who never gave up her US citizenship. She lived in Canada under a work permit and at no point applied for Canadian citizenship or permanent residence.
The U.S. citizen parent must have been physically present in the United States for at least 5 years, including at least 2 years after 14 years of age which she did.
Obama’s mom married and left the US at age 14. When Barack Obama was born in 1961, U.S. citizenship law provided that, if born abroad, he would have acquired citizenship at birth only if his mother, Stanley Ann Dunham, had been physically present in the United States for 10 years, five after the age of 14. She was only 18 when he was born and thus could not have transmitted U.S. citizenship to him as she had not been on the US for the five year limitation and was living in Indonesia.
It was later determined that Barack was born in Hawaii, which is what got him qualified for office. He couldn’t use his mother’s citizenship based on her time outside the US.
Of course, there were also a number of other things that were lied about, but that’s why his capacity was in question and decided.
