Not necessarily. These guys are whistleblowers. They have been making statements to the MSM giving their personal opinions.
Without reading the actual suit, it is hard to determine if the suit is against the IRS (USG) or the whistleblowers. Will the IRS blame Congress and the whistleblowers?

I’m no lawyer, but could this be used to delay charges against him? At least until the election is over? It seems this could be argued that the ‘complex legal situation’ needs to be resolved before moving forward...avoiding the embarrassment for now.

We now have the “Trump exception” which does not apply to all laws, regulations, and precedents, and the “Biden defense” to all crimes, including violations of all bribery, extortion, tax-avoidance, and gun laws.
