My state now has the Castle Doctrine, which gives a person enhanced legal protections when he is in his own home.

Before that, we were a “duty to retreat” state. Years ago, a homeowner shot a guy who was breaking through his house’s front door. The homeowner was convicted of a felony because he was supposed to retreat through the back door.

“Alleged” .... Dictionary says “Represented as existing or as being as described but not so proved”. By that definition, we could say “Alleged President Joe Biden”

pretty much how the Colorado Castle Doctrine law is written, too ... uninvited intruders inside are totally fair game ... after a couple of failed test cases when the law was first passed, LEOs don’t even bother anymore going after the homeowners being intruded upon ... they just say “shooting justified” ...

A little vague about whether he entered the home, or tried to enter the home. I would think that might be a sticking point.
If he made it through the door, he became a threat to her life, no doubt. If he just tried the door handle, but didn’t enter, she could be in for trouble.

I hate to be a “good shoot” nerd, in my State you can shoot outdoors “within the curtilage” of your home, but probably not in California.

IOW, if she shot through a closed door, she’s going to have a problem, if he got the door open, probably not.

That’s how it works here. I’m back in the hills of rural TN. If we call the law, it takes 45 minutes for them to get here if they aren’t already in the area. They always say, “if they get in before we get there, shoot them”.

Why isn’t the homeowner “alleged” to have shot the intruder? Do I see biased reporting? No can’t be everyone knows the press is fair.

If she sticks to this:

“The woman said he kept reaching into his pocket, leading her to believe he had a weapon”

that’s a game changer. In a self defense situation you can say really stupid stuff, or really smart stuff. That’s really smart.

Suckers Bet, she most likely will be charged. Generally in California, the intruder has to actually ENTER your home before you can legally use deadly force. I live here and that’s the way it is, I tell everyone just wait til he crosses the threshold, then have at it.

If I’ve read the law correctly, here in Texas after dark if you even SUSPECT that someone is on your property intending to commit a felony level crime, you can blast away.
During daylight hours we have to follow the Castle Doctrine. Of course it depends on what county you’re in how aggressively that is enforced. Where I am I expect local law enforcement would call any dead perp a good shoot.

In TN, the local Sheriff is the law of the land, pretty much.

When I was younger, I lived way back in the mountains with a toddler. Three men pulled up but a stray dog I had taken in wouldn’t let them out of the truck. I called the Sheriff to ask if he knew who the hunting dog belonged to and he said yes. When he showed up with the owner of the dog, he asked me about the men. After I described them, he told me that if they came back and got out of the truck to shoot them dead. I mentioned the law about them being in the house first and he said to shoot them anyway and he’d have his ‘boys’ come drag them in and write a report. A lot of what happens depends on the Sheriff.

Allegedly, the alleged woman allegedly saw the alleged intruder in her alleged backyard and allegedly saw him allegedly make his alleged way to an alleged back door and allegedly try to allegedly enter the alleged home, alleged FOX 11 allegedly reported.

Thought the story needed more cowbell...
