I agree with your comments. My point was that Biden could immediately nominate Smith, and the Biden senate, with its Democrat majority, could immediately approve his nomination.

I have no legal training. I don’t know what point you think I missed. I merely responded to Meese’s argument which I accepted as legally true. I was just pointing out how quickly the administration could legally re-install him as Special Counsel.
Meese’s point is that no such position exists because Congress never created it.
So it doesn’t even have a name.
For a long time I have been wondering where Smith got such power since he was supposedly only appointed to respond to the NARA documents hoax. He and Garfinkel used the “and other matters” clause of his “appointment” to veer off into the January 6 hoax. Using a cute little catch all clause like that is an end run around the Congress.
So there is no such position. And the Republicans have been opposed to such beasts since Watergate/Archibald Cox and Iran-Contra/Larry Walsh. The position of Grand Inquisitor is an exquisitely Catholic invention dating back centuries. It is always about accusing others of heresy and recommending Draconian penalties for Deviance From the Official Dogma.
They used Ken Starr on Bill Clinton to make that point. No one actually gave a s**t if Billy Jeff got hum jobs from some round heels but they showed the Rats that the game goes both ways. That’s why the Independent Counsel law sunsetted in 1999 and no one tried to revive it.
Garfinkel can’t do another end run by textual fiat.
