In the State of Washington, the cops can’t even look through your trash at the curb if they don’t have a warrant. However, my guess is the WASC would make a different decision today.

If you are using a "hands free" connection through your car, the car computer automatically downloads contact lists and call logs from your phone when it connects to the car. That includes text messages that were on your phone.

The information remains in the computer after your phone is disconnected. It is accessible with the right equipment and software.

Whether information can be erased from the car computer is one of those "trust us" questions. I don't really trust the public relations people who are answering those questions. Anybody know the software engineers who develop the systems?

I get the sarcasm but let me share how it really works. Because their MO is dishonest you don’t have to do anything illegal and they will turn it into something illegal.

Example:

You pull over shut the engine off and make a text to someone. You get back on the road and continue on your way after texting the safe way. An officer pulls you over for a tail light or license plate light out. He downloads your car information. It shows a timestamp where you just texted ten minutes ago. But purposely and completely ignoring the fact that the data ALSO shows you were stopped with the engine off when you made the text, he will write you a ticket for texting while driving anyhow.

Now you are unduly and wrongfully placed in “the system”. And because you know you are innocent you are placed in a situation of hardship and defense of your innocence because as an an unquestioned expert witness who is never wrong it is now your word against his. You are presumed guilty before you are innocent and now have go to lengths and expense to prove your innocence. Ever fight a ticket? It is almost impossible and most judges will not even allow you to include evidence from the very same device that could prove your innocence. The officer can, but you cannot.

So even though you are completely innocent you are going to lose and pay a large fine and have your insurance rates double for the next five to seven years. Do you think the officer, the DA, and the Judge care?

Absolutely not, they were all just “doing their job”... Except the only honest party in the whole mix was you. And THIS is why we need to make sure doors like these are not allowed to be opened with the perspective of “Unless you are doing something illegal, what do you have to worry about?”

Because many times it doesn’t matter if you even did something illegal or not. Eight out of ten officers will lie if it makes themselves look good and get Barney Fife points for doing their “duty and serving the public”. And the masses never question their word... Been in this situation many times over the years.

Grandson got some expensive sweat pants from his favorite band... They come with a “tracker of some sort” sewn in so you can scan with your phone and get deals on different items and they (whoever the F’ “they” are) keeps track on line of your purchases.

I told him I’d be hitting it with a hammer.

It has been said by Professor Harvey Silverglate, that due to the complexity of our laws, "Everybody commits three felonies a day". That is probably underestimated.

If you include misdemeanor "crimes", you are looking at more than 100x that number.

When police have more information about individuals, they have more opportunities to fit them for some type of "crime". It does not even matter if they are guilty of anything. "The process is the punishment", and if you are singled out for official harassment it will get very expensive for you very quickly. We already see a weaponized "Justice System" which is being commonly used against political opponents of the Democrats.

Nothing good comes from allowing police to have unlimited access to personal information about members of the general public. That is especially important when we have a malicious ruling class who are willing to use everything they know about us to use against us in a so-called court of law.

Good post.

The other danger that most Freepers do not understand is “parallel construction” of prosecuted cases.

By this I mean that there can be a secret investigation using illegal means of surveillance and data collection that gives the authorities the data they need to figure out how to conduct an investigation they can present to court using legal means.

If you add potential political prosecution/persecution of those with “undesirable” or “extremist” views abuse is certain.

In simple terms—they have (for whatever reason) decided who they will prosecute—they then just have the tactical decision of what evidence they will choose to provide in court.
