Yahooooo! I've been pointing this out to my congressman for years. He was so proud of a reward program and suggested that was pitiful, that he should read the Constitution and use the Letters of Marque and Reprisal power given to Congress. They do so much that is unconstitutional, why don't they do some that is constitutional. It'd be a hell of a lot cheaper and more interesting. Small groups are going to come up with a lot more interesting solutions than the bureaucratic Pentagon, which can be seen coming from a thousand miles away. This is also the way to split the supporters off from the leadership. Some guy says to himself, gee, maybe I can pick up a couple of million dollars pretty quick and get out of Dodge. This would be very effective and would create fewer objections from allies, semi-allies and enemies.

This sounds like a great idea. However, how about including some incentive to NOT harm innocent civilians? Say that the letter does not protect you against criminal charges for reckless and malicious killing, and that even neccesary killing of innocents looses you $1M for each innocent killed? It would be up to the attorney general of the US to prove reckless and malicious killing, and it would be up to the families of claimed innocents to make the case for innocents. The families would get the $1M if they could show that their departed was innocent.
To be cold-blooded about this, that means that if, using your pay scale, you manage to kill Bin Laden, you could kill 99 innocent people who were legitimately in the way, and still make $1M before expenses. This seems like a reasonable, but not extreme, incentive to get a clean kill. If you just go around killing people in the hopes that one of them is Bin Laden (say with area weapons), but no attempt to avoid killing innocents, then that would be reckless and malicious, and you could be charged in the US.

One thing should be added: the operative should have the right to get additional scalps on his own initiative - on the condition that he can prove it in a court of law. Of course, failure to provide such proof could result in murder charges from the US or a foreign government.
I simply don't trust the government to be capable of identifying terrorists, never mind rooting them out.
