Texas Man gets 75 years for striking policeman

REFUGIO - A Refugio County jury Friday sentenced a 33-year-old Woodsboro man to 75 years in prison for striking a peace officer.

Robert Lee Ortega was sentenced after the jury found him guilty of striking Woodsboro police officer Doug Carter.

The officer testified that Ortega used his hand to strike him in the chest and twice in the face. The assault came when Carter attempted to arrest Ortega after his car sped away during a traffic stop in Woodsboro.

Terry Breen, the prosecuting district attorney, said the penalty for assault of a public servant is normally a third degree felony and carries a penalty range of from two to 10 years. But because of his prior criminal record, Ortega was classified as a habitual criminal which increased the range of penalty from 25 to 99 years or life in prison.

Testimony during the trial told of Ortega's being sentenced to prison in 1996 after a conviction of felony driving while intoxicated and an earlier convictions of assaulting a peace officer and injury to a child.

"This jury sent a strong message to the criminal element," Breen said. "Don't touch a cop when he comes to arrest you."

The trial got off to a slow start when not enough potential jurors showed up for duty Monday, causing Sheriff Jim Hodges's office to notify people to "drop what they were doing and come to the courthouse," Breen said.

So as I understand it, the State of Texas has just sentenced itself to spend two or three million dollars incarcerating this guy for what look like pretty piss-ant crimes. This is smart?

75 years, Is this for real? I don't care if you struck a pregnant women, unless there was a serious permanent injury the sentence is is crazy. David Berkowitz and a host of cop killers get alot less time. Does anyone in texas remember that punishments are supposed to be proportional to the crime. how about this headline, a texas man who punched a armed man 3 times was sentenced to 75 years in jail while in the courtroom next door a convicted child murderer was sentenced to 20 years. CRAZY.

Murder gets you 6 today, Rape abot 12 mo. on good behavior. This guy strikes the one of the government elite, he's imprisoned for life.

This seems ridiculous. Looks like a prosecutor overreaching for the gold like they do ...actually got a crazy judge and they piled it on.

I hope the guy has some luck on appeal. 75 years is a long bit to work off.

I can't see this sentence holding up but this poor fellow has a lot to work off in appeals.

This is the reason that Ortega received a long prison sentence. This piece of scum won't be committing any more crimes for a long, long time. Hip, hip, hooray!!!
