NEWPORT BEACH, Calif. (AP) - The son of an Orange County assistant sheriff and two other teenagers have been charged with the videotaped gang rape of an unconscious 16-year-old girl.

The 17-year-olds, who were all charged as adults, face 21 felony counts that include rape, rape by a foreign object and administering a drug to incapacitate the victim.

Well, there you have it. I guess they need to drop the charges against him.

I guess they need to drop the charges against him.

Obviously. Anyone who helps their mother couldn't possibly do such a thing.

On the other hand, if they are convicted, I have some thoughts on appropriate sentencing...

Outside the courtroom, attorney Joseph G. Cavallo, who represents Haidl, said his client was "holding up as well as can be expected for a 17-year-old."

I wonder how the girl is holding up. Anybody care?

An excellent question. Sadly, it appears that the answer is "no".

In other words, these are middle-class or upper middle-class white boys, and as everyone knows, middle-class white boys would never get into any kind of serious trouble. (/end sarcasm)

"...I don't like him because he thinks he's hot stuff," classmate Victor Barome said. "He tells people that he can get away with things. He brags that he knows people and (that) if he gets into a jam he can get out of it."

Krystal Arnold, 17, said she'd dated Haidl briefly during their freshman year and was not surprised to hear of the charges.

"He's perverted and pushy," she told The Register. "He tried to, like, do things with me that I didn't want to do." Arnold did not elaborate, but she did say she was surprised to hear Spann had been charged in the case..."

The teens' hands and feet were shackled. They bowed their heads behind a wall

I hope they spend lots of time behind walls.

They have them on video. Why a trial? He helps his mother? You sick bastard! Everyone has a right to a fair trial. No they don't, when that was written into our constitution, video did not exist. This is not like seeing a police video, where you do not see what led to the events. These little bastards taped this themselves, for their own "pleasure". They drugged a girl and raped her, they should be put in a room, doped up and released to a 300 pound man to have his way with. An eye for an eye. This poor girl's life is forever changed for the worse and this jack-a$$ "helps his mother". God have mercy on our souls...

Why a trial?

You have to have a trial to make sure the evidence is aired in public, and to reduce the chance of somebody innocent being railroaded by the police and court systems because they are unpopular or disliked for some reason. I like this system, and want to keep it. If the evidence is strong, they go to jail. If it isn't,they don't.

The girl, who lives in San Bernardino County, did not report the rape, said Newport Beach police Sgt. Steve Schulman.

I wonder why she did not report the rape.

Sheesh! Gone off your meds again? When the evidence is so strong, the trial is a formality -- but a necessary formality -- otherwise hotheads like you would continue to erode trials by peers until no one got a trial -- just the town Taliban council passing sentence.

In the U.S. Constitution the founding fathers wrote in that anyone has a right to jury trial.

I can understand your outrage at this outrageous crime, but please don't trash our system of justice.

When they show that tape to the jury, those little dirty pigs will get theirs.

Does anyone know a 15 year old boy who is permitted to date in this common culture who is not pushy and will not try to talk his 15 year old girlfriend into doing things she didn't want to do?? Is this really uncommon? I can remember some fast-talking 15 year old boys that I had to say no to. NO. It worked and I didn't date them again.

The only justice for these 3 sick bastards will be when they themselves get raped in prison. The only difference is that they wont have the pleasure of being drugged.

I don't think she is implying that he wouldn't stop. In these sensitized days she would have not been surprised that he was implicated in a rape if she was talking about the fact that he was hard to stop.

The boys should be locked up for what they did to this girl, but I do have a question. What is the legal age of consent here? I know the girl was raped, but if she does not press charges, is there an actual case? I ma not trying to get flamed here, just curious.

Exactly. The article plays up the fact that the 17 year old is a "model" teen and holding up as well as can be expected. They are trying to turn the rapist into a victim.

Where have we seen that tactic used successfully before?

I guess since it falls outside the boundaries of his school work, it should remain a private affair.

I know she was raped, but if she chooses to not press charges I can't see where there would be a case against the boys. All of whom deserve a very long stint in closed quarters.

I think there are some crimes that are prosecuted despite the wishes of the victim. Domestic violence is one- a police officer will arrest an individual for violence against a partner even though the victim may not want to press charges.

Since rape is a felony, the victim may not have any say in the matter. I'm curious as to why she wouldn't press charges though. Really odd.

The article says that she ``did not report the rape'', but she still could have pressed charges. Since she was unconcious she may not have recalled the attack. Or she could have been intimidated by Haidl's appartent attitude that he is above the law by his father's position in the PD.

It's concievable that the police found out about the attack by these guys bragging about it or showing the video to their friends. The victim may have then chosen to press charges after being informed by the authorities.

Finally, the use of the drug to incapacitate the victim would probably automatically trigger charges, unless the girl specifically told police that she consented to take the drug. Hope this helps.

The Mothers and Fathers Italian Association has a punishment regimen which would assure a positive outcome. For those who are not familiar I suggest that you read "The Vallachi Papers".

I for one would like to see these young gentlemen dressed up in a "girlie" fashion and introduced to a prison population who would visit the same treatment, (sans the unconsiousness draft. Better they're awake!!!) on them.

Am I POed? You betcha.

Yes, I agree. I wonder how this young woman was "holding up" as she was being physically attacked. And for the person who too really didn't take part...why didn't he try to stop it then? And as for his past being void of a criminal record...guess what? He's gonna have one now!
