That's only because of a bad U.S. Supreme Court decision made 30 years ago that desperately needs to be challenged soon. A lot has changed in the U.S. over the last 30 years, and whatever arguments that may have sounded valid 30 years ago when this matter was being argued before the U.S. Supreme Court would probably sound a lot less valid today.
