U.S. is told to say why man held

NORFOLK, Va. - The U.S. government must explain within a week why it is holding prisoner an American-born man who was captured with Taliban fighters in Afghanistan, a federal judge ordered Thursday.

The judge also directed the government to spell out with whom the United States is fighting its war on terrorism.

Prosecutors have argued that Yaser Esam Hamdi, 21, can be held indefinitely without charges because he is an enemy combatant in that war.

"Will the war never be over as long as there is any ... person that may feel they want to attack the United States of America or the citizens of the United States of America?" U.S. District Judge Robert Doumar asked during a hearing.

Mr. Hamdi was captured in November after a prison uprising by Taliban and al-Qaeda members. Later, it was discovered that he was born in Louisiana to Saudi parents and had moved to Saudi Arabia with his parents while a child.

He has been held in jail at the Norfolk Naval Base since April. Only government interrogators and Red Cross representatives have been allowed to see him. Prosecutors have argued that Mr. Hamdi might pass secret messages to terrorists through his lawyers.

Uhmm… just a guess here, but maybe it’s because he’s an American-born man who was captured with Taliban fighters in Trashcanistan? I just gotta think that somehow factors into it…

I have no problem with this individual being named and enemy combatant, and I have no problem with him being held indefinitely. If any citizen hates America so much that they would go fight with the Taliban or alqueda, then these are the consequences of that decision.

Revoke the misinterpreted 14th Amendment citizenship clause! This terrorist was born to saudi not american parents, foreign national parents around the world are using anchor babies for the benefits of your tax dollars.

This is what I am afraid of. I know where this Judge is going. DOJ has to be on drugs to hold both Handi and Padella like this. The Argument can be made that Handi is an Enemy Combatant since he was captured by the US Military in Afghanistan. However, why he was brought back from GITMO to the States and not charged like Lindh was really a foolish mistake by DOJ. Padella is an entire different case.

These terrorists are going to make fools of our Justice System and set some real bad precedence.
