Regarding Elian's story, it should be noted that the press was very helpful in distorting the reality of the truth in this case.
Maybe because of lack of information, knowledge about the situation in Cuba, or merely, because laws in the U.S. are non-existent in communist Cuba.
When fidel kastro's government took by force the Island, amongst the first laws enacted was the "Patria Potestad". You must check about this to prove that this is true. This law gave powers to the government to educate, control, instill, indoctrinate, the communist ideal into children without the approval of the parents, as the government was the "real owner" of the children and children were trained to "tell" on their families if at any point they overheard any remarks against the government. This is the usual procedure in all communist regimes, moreso in the one that took power in Cuba with such strong force.
Therefore, the laws considered in the U.S. for U.S. citizens and children and the parents of these children, had no value whatsoever in the Cuban Island. It was non-existent- and not valid. Having this been the case, why hasn't kastro sent back to the U.S. the large number of children claimed by their parents and being held in Cuba against their wishes?
To make things more distressing for Elian, he was born out of wedlock, after his parents had been divorced, and he was not legally registered by his father, due to whatever reasons there were, we can say lack of systems in the Island, or just forgetfulness, indifference or just didn't care to do so, until the time that the U.S. government requests proof of fatherhood, and at this point the Cuban government does the paperwork to show proof to the U.S. At no point did Juan Miguel Gonzalez was interested in getting Elian back, the only one interested was the Cuban government.
These and other reasons behind this case, produced a very sour taste in the mouth of all Cubans in this area and in any areas in the U.S. as much as in Cuba, even though they cannot publicly claim anything, and had to show up for the "mounted show" of obligatory presence for the government's benefit to show the world.
Please, do not be naive and believe that all those you see parading in front of fidel's speeches are with the government. 90% of the Cuban population is against the government but there is not much they can do about it due to repression, lack of human rights, enjailment for discrepancy with the government and the need to keep their jobs. Plus the fact that you have to considere there is no freedom of speech or anything for that matter in the enslaved Island.
It should be noted that there was no need for Janet Reno to make such a presence of force, against a 6 yr. old child, in the middle of the night, with guns facing his scared face, in order to pull him out of the loving hands of relatives that had been given the authority by his own father months before to keep the boy here after his mother's drowning. His father never moved a finger to see the child or get in touch with the family to come to an agreement. All this show was perpetuated and created by the criminal dictator in Cuba and the U.S. with a President that agreed to it, in order to have his regular shipment of Cuban tobacco sent to him via whatever means there were, and his right hand Reno that agreed to give this power to Castro to show the world that he was in command.
We cannot forget that this is the "modus vivendi" of Reno. I don't think anyone can forget WACO and the cost of lives of children in that search and shooting spree. The fact that the WACO people were right or wrong should have been decided in a Court of Law, not by the hand of Reno and her followers, performing raids against children similar to those carried out against drug-dealers, as she again repeated against Elian Gonzalez.
I only wanted to clarify these facts for you, as it seems from your paragraph that you do not know the in-depth reality of the situation, be it in Cuba or in the U.S. and how facts played in favor of Castro at the hands of Reno using the power she had in her possession at the time.

1. The INS originally placed Elian with his American relatives. US regulations in such cases say that a State family court will decide custody, and an INS spokesman said this would be the case with Elian. The Clinton Administration then went against their own written and spoken positions and awarded custody to the biological father.
2. Juan Miguel was never out of the control of Cuban officials. In other words, he never had a chance to defect or to freely express an opinion. All we have are the words of Bill Clinton, Fidel Castro, and Janet Reno that Juan Miguel's wishes were being followed.
I said it last night; two elections have been settled due to Elian's kidnapping by our government and we owe a hell of a lot to that little boy. He's kept two miscreants out of office....
