Turnoff will announce a settlement between Judicial Watch client Ricardo Ramirez and officials of the Justice Department and its Immigration and Naturalization Service over claims of a hostile workplace environment and retaliation during and after the Elian Gonzalez saga.

INS, Agent Settle Discrimination Lawsuit Filed in Wake of Elián González Raid

An Immigration and Naturalization Service agent who blew the whistle on fellow agents following the raid to remove Elián González settled his lawsuit accusing Attorney General John Ashcroft of failing to act on his complaints of anti-Hispanic bias.

With most terms of the agreement secret, it is unclear whether taxpayers are going to provide a financial payment as part of the deal announced Friday between INS Agent Ricardo Ramirez and federal negotiators representing Ashcroft and outgoing INS Commissioner James Ziglar. Ramirez, of Fort Lauderdale, said INS agents and administrators in the Miami office created an aura of bigotry and intimidation, rejoicing in the Cuban rafter's removal. He said Ashcroft and Ziglar failed to act on his complaints.

''The terms of the agreement are amicable and favorable -- that's as much as we're going to be able to say,'' said Ramirez's attorney, Larry Klayman of the government watchdog group Judicial Watch.

Klayman said the government has publicly promised that INS will not discriminate or retaliate against Ramirez or any other employees.

U.S. Attorney Marcos Daniel Jiménez said the Justice Department has reaffirmed its commitment to non-discriminatory and non-retaliatory policies as part of the settlement.

Ramirez could not publicly acknowledge if he will be returning to the INS office in Miami, or Texas, where he worked for 14 years as a Border Patrol agent, or another post.

''I'm very pleased everything went well,'' said Ramirez, who attended the hearing in a Judicial Watch T-shirt.

Both sides praised U.S. Magistrate Judge William C. Turnoff, who presided over the settlement talks. Turnoff was slated to rule on a government motion to dismiss the case Thursday. If Ramirez prevailed in that hearing, the trial was slated to begin on Monday.

With Turnoff mediating, the settlement talks stretched late into Wednesday night and weren't ratified until 2 a.m. Thursday.

Klayman said the settlement contains provisions to make INS and the Justice Department accountable. If Ramirez and Judicial Watch believe the U.S. isn't complying with the terms, they can file papers asking Turnoff to declare the government in contempt.

''The proof's in the pudding,'' Klayman said.

It is unclear if those possible contempt motions would also be filed in secret.

Big victory for JW. Mr Ashcroft SHOULD have been investigating Janet Reno for the past year, instead of hunting down and prosecuting terrorists here at home. Shame on Mr Ashcroft! </sarcasm>

Actually, we can't infer conclusively anything other than "we promise not to do it."

But, at least the guy got a JW T-shirt.

When Larry has absolutely nothing to say, he makes something up. So what's up with this?

Whatever the settlement agreement was, it required Klayman to keep his mouth shut about it, which is a major coup right there.
