I get the indication that Martha Stewart may be in a bit of legal trouble. Is this general consensus? In order to sustain a criminal conviction of MS, the Govt needs to prove she had access to insider info when she sold her ImClone stock, and that she knowingly profited from that insider info.
Nothing I have seen in the press, on TV, or in any chat room leads me to believe that MS knew she had inside info when she sold her stock. OTOH, little Dumbya was an insider when he sold his HEC stock at a profit of about 100x that made by MS. Therefore, the Govt should prosecute little Dumbya, not MS.

She obviously had inside info --- it's open and shut. And as a former securities broker she knew exactly what that info meant and exactly how illegal it was to act on it. The timeline alone proves her access to inside info. Now that her broker's assistant is tesifying to the specific nature of the info in addition to the sequence of events, Stewart is toast.
What you must mean is that unless you hear a tape recording of someone telling her that the FDA was denying the application, you refuse to believe that a television celebrity whom I assume you like could break the law. My advice to you: Get over it. She's guilty as hell.

Importantly, she is not an "insider". To be convicted of "insider trading", she (an "outsider") would have to have been given a tip by an "insider" (such as a company Officer) and she would have to know that the tip had not been given to the general public. That's tough to prove. Executing a trade on a tip from a stock broker or from a non-Officer company employee in not "insider trading". I think Martha is just an easy target for the media. Stories about her sell ads for them.
