Commenting on Sacramento's Golden Empire Council of the Boy Scouts of America not applying for United Way funding,  council executive Doug McDonald says, "I don't think Scouting has seen its demise or will anytime soon," but he added that acquiring funds is more difficult. One California based organization is not so confident and urges patriotic Americans to draw a line in the sand and support the Boy Scouts financially in it's fight for survival. "The legal profession in California has just fired a warning shot across our bow," reads the headline at Patriotwatch.com.

While the scouts organization has stood fast in its right to oppose admitting gays and atheists, it now faces new assaults from those that would be called upon to protect their constitutional rights, the judges of California and the federal bench. "In the Patriot Defenders Network's opinion, this is out-right war, tantamount to domestic terrorism" says its director Dave Jenest. Recently, Scout Council's McDonald was quoted in a Sacramento Bee article as saying, "I remember the Vietnam era, when we were criticized for wearing uniforms and being militaristic."  Jenest asks, "Will they apply a 'Nazi Youth Movement' label next?  Will there be a court left in this land to protect the scouts or any other patriotic organization if the 'Supremes' have their way?"

The latest controversy stems from yet another Sacramento Bee article today entitled High court will weigh scouting ban for judges. The item leads with, "Spurred by two of California's largest lawyer organizations, the state Supreme Court said Thursday that it will study proposals to bar judges from belonging to the Boy Scouts because the organization discriminates against homosexuals."  "So much for being 'pro-choice' when it comes to one's right to 'free association' protections afforded by our U.S. Constitution.

The article goes on:

The justices' announcement gave no hint as to how the issue might be resolved. It was so cryptic that "Boy Scouts" and "homosexuality" were not mentioned. But it acknowledged that the genesis was a pair of proposals from county bars in San Francisco and Los Angeles, the leaders in a push to change judicial canons of ethics to forbid Scout membership.

The Santa Clara County Bar adopted a similar resolution. The Alameda County Bar is weighing one.

"I do believe that the tide is turning," said Angela Bradstreet, president of the Bar Association of San Francisco for the past year and the leader of the movement. "I do believe that there's a real momentum now for a change."

California Chief Justice Ronald George is "clearly taking it very seriously," said Bradstreet, who had an hourlong meeting with the chief justice to discuss the resolutions last week.

No wonder Shakespeare suggested we all shoot the lawyers. It's time to reclaim our heritage and defend our rights against such assaults. Begging the larger question, "when is it time to impeach the 9th Circuit Court" perhaps we can strike back with our wallets instead of our mouths. This Christmas season or "Holiday" season for those on The Court who would object to Christ's birth being celebrated, perhaps a donation to the Boy Scouts of America is in order. Perhaps Free Republic Network Chapters could ban together and urge 60,000 FReepers craft a strategy that will unite conservatives in support the scouts and taking on each bar association that has pledged to support this lunacy in our courts.

With all the resources and resolve of Freepers, can we find a way to launch a preemptive strike and tell the media, the courts, our legislatures and our President that we've had enough?. Please give it your FReeper best!

As for me, one of my finest teachers and role models was my Scoutmaster, Dr. Carl Zapffe. He was Scoutmaster of Troop 35 in Baltimore, Md., for forty years. In that time he turned out more than 240 Eagles.

Balancing the Ninth

It was the fifth time the Ninth Circuit had been reversed in a month. Seven of eight cases already decided by the high Court this year from the Ninth Circuit have been reversed, and six of those seven were by unanimous or nearly unanimous rulings. A few years ago, the Supreme Court even took the extraordinary step of issuing a special order barring the Ninth Circuit from issuing any further last-minute rulings in a death penalty case. The year I was fortunate enough to serve as a law clerk at the Supreme Court, 28 of 29 cases from the Ninth Circuit resulted in reversals. It is almost as if one could write a word processing macro — call it the [Alt-9] macro — which would automatically insert at the end of any opinion involving a case from the Ninth Circuit the following conclusion: "The opinion of the Ninth Circuit is reversed; the decision of the Court is unanimous."

The Ninth Circuit is by far the largest Circuit Court in the country. It is the largest geographically, covering the western states of California, Arizona, Nevada, Oregon, Washington, Idaho, Montana, Alaska, and Hawaii — more than one-third of the entire nation. Thus it is no surprise that the lion's share of cases taken by the Supreme Court each term recently come from the Ninth Circuit, but it does not explain the high reversal rate.

THANK YOU! A most excellent treatise on the subject. I am not surprised, albeit saddened that only three FReepers would reply or engage in the discussion. For those who prefer FR-Lite:

Even now, because Congress has not used impeachment as a check on the judicial branch, it has become "so weak and torpid as to be capable of lulling offenders into a general security and indifference," as Justice Story warned it would. It is time to revitalize impeachment and to rein in the federal judiciary."

I fear Edmund Burke would be shot at sunrise were he alive today. Finding a list of probable suspects would be no challenge.

Remedy's stats on the Supremes seems to suggest what any reasonable person would conclude: were we to perform in such a manner, would ANY employer be sanctioned for firing us? "We the people" must demand the same of public officials!

Someone will take this to court. It will be decided that the Bar associations have no right to do this. At least this time it won't be the BSA's money that's being used up on lawyers.

Citizen's Call for Action Petition
to Members of the House Judiciary Committee

I am alarmed and outraged at the tyrannical action taken by two of the judges from the Ninth Circuit Court in banning our Pledge of Allegiance! Please heed the voice of the people on this. We must take action to defend the heritage, the faith, and the freedoms of this great nation by IMPEACHING judges Alfred T. Goodwin and Stephen Reinhardt. They have violated the Constitution by ignoring the will of the people. The framers of our Constitution intended checks and balances to keep freedom alive in this country. Sadly, the judicial system has remained unchecked far too long. I feel that IMPEACHMENT is the appropriate action against these judges who have violated our trust and their Constitutional role. If we do not act, the integrity of our democratic system is at stake and judges will continue to legislate their personal agendas from the bench. Please do everything in you power to start impeachment proceeding on these judges. It is a critical move for the future of our nation!

Another German organization friendly to open homosexuality was the Wandervogel (Birds of Paradise). A mostly male organization which came into existence before World War I, it was described by Nation writer Lewisohn as "the youth movement from which thousands of storm-troopers came." Toland describes the Wandervogel as youngsters who "tramped around the land, often wearing colorful costumes, in their search for a newway of life." His description of them creates the impression that they were a movement of rebellious youth -- denouncing the perceived hypocrisy of adult society, looking for a sense of purpose, and seeking to express their originality and distinct generational identity: [31]
For the most part from the well-to-do middle class, they despised the liberal bourgeois society they sprang from and were convinced that 'parental religion was largely sham, politics boastful and trivial, economics unscrupulous and deceitful, education stereotyped and lifeless, art trashy and sentimental, literature spurious and commercialized, drama tawdry and mechanical.' They regarded family life as repressive and insincere.

No doubt, if the trend continues in California, you will find "The Poisoned Stream" topping the list of hate materials and anyone who might dare to quote from it, accused of hate speech. I have not digested the entire article yet, but recognize the patters of revisionism to my own personal disgust.

That said, I find it troubling, once again, that our topic was pulled from breaking news and thus a wider audience. I really appreciate the thought provoking dialogue that has surfaced. I should think the antics of the 9th Circuit in this most recent debacle would have stirred some debate. Must be my lack of posting skills that is responsible. Some people just can't look tyranny in the eye, let alone, plot a course to oppose it. Open to suggestions and ideas...

The fascist Gaystapo is in overdrive again, seeking to take away the Constitutional rights of government servants. Soon a judge won't be able to attend an all male poker night or to be a member of the Catholic Church. The fact is, judges, lawyers, etc. etc. have every right to associate with whomever they want - for whatever reasons they want.

Addresses 2nd Amendment in Upholding State Ban on Assault Weapons A federal appeals court in San Francisco on Thursday found that individual citizens do not have a constitutional right to own a firearm, cutting to the core of the modern debate over gun control and repudiating the gun lobby's most cherished legal argument.

The 9th Circuit establishes law for nine western states, including California. DIAL 911 & DIE OR:

Liberty Counsel ,Urgent Petition, The Ninth Circuit has always been a radical, left-leaning court. A recent survey showed that 80%-90% of the Ninth Circuit’s decisions are reversed by the U.S. Supreme Court. In one recent term, the Supreme Court reversed 24 of the Ninth Circuit’s decisions, and 16 of those decision were reversed by a 9-0 opinion by the United States Supreme Court. It’s hard to find the United States Supreme Court unanimously agreeing on anything, but one thing it has agreed on is that the Ninth Circuit is in left field.

It is time for Congress to take action and impeach the two judges on this Federal Court. They will only act if we all get involved and let them know our outrage. I am asking you to sign this petition and forward it to all your friends. You may not be able to go overseas and fight for our freedoms, but you can take a stand by signing this petition.

One of the two judges in the majority, Stephen Reinhardt, is a holdover from the liberal judges appointed by President Carter. This judge is even left of the Ninth Circuit Court. Judge Reinhardt once issued an opinion that the United States Constitution guarantees the right to assisted suicide. This decision was overruled. During one term of the Supreme Court, this same judge was unanimously reversed 5 separate times by the High Court on 5 separate cases. Obviously a judge like this does not belong on a Federal Court.

This petition will immediately be forwarded to all 535 members of the U.S. Congress. Those members have the authority to remove these judges. This petition will also be sent to President George W. Bush.
