State Supreme Court to review Berkeley's decision against scouts

SAN FRANCISCO (AP) -- The California Supreme Court agreed Wednesday to review Berkeley's decision to discontinue free berthing at the city's marina for a group affiliated with the Boy Scouts of America.

The justices agreed in their private conference to hear the Sea Scouts' challenge. The scouts are fighting a 1998 city decision that halted free berthing for the nonprofit group because of the scouts' membership and leadership policies against gays.

The municipality is NOT entitled to it's policy since the municipality is essentially your basic jackbooted thugocracy sometimes mistaken for an agency of the state!

Government may not discriminate in this manner. That's what the US Supreme Court said.

Now, if the thugocracy there in Berkely wants to set itself up as a private community with private roads, etc., I suppose they could do that.

Actually, total privatization of Berkely would be good for all of us. They should be encouraged.

They essentially said: "Either PROMISE that you won't ever discriminate in this fashion at any time in the future... or we won't give you any of our money."

Actually, they said, "Promise you won't discriminate in a way we don't like, or we won't give you, and only you, any of our money."

The other non-profits that use public facilities discriminate in all sorts of ways, by gender (women's-only groups), disability (deaf organizations are not required to have hearing members), age (they aren't making AARP take 30 year-olds), etc. What they have said is that the Sea Scouts may not discriminate and receive funds, but other organizations that might discriminate on the basis of sex, race, etc. (whose discrimination is the kind that the city likes), still get the free use. That's not equal protection of the laws...

They give money and free berthing to other groups. Wammo that is descrimination by the people/govt/goofies of berkley. Caint do that.

I imagine you're correct about this, but does anyone have a list of the non profits that officialy receive aid/money/etc from the municipality?

What is not mentioned in this story, but has been in others, is that there was an arrangement in place between the Sea Scouts and the City, in which the Sea Scouts performed labor in and around the harbor...my recollection is that they constructed breakwaters...in return for the free berthing.

The Scouts delivered. The City renegged.

I don't have sourcing for this, but I do distinctly remember that my opinion was that this was more of a breech of contract situation, rather than a discrimination issue.

I don't think discrimination BY the government (out tax dollars) can be considered the same as a private organization not allowing people who encourage and act out immoral and deadly behavour, behavour that goes directly against against the Christian and Jewish (and Musilim) faith, to be members and/or leaders of young boys.

but, presumably, the COURTS understand the law,

BWAAAAAHHHHH, HAAAAAaaaaaa, HAAaaaaaa, Haaaaaaa, haaaa!!!!!!!! Ohhhh... Great one! The courts understand the law... NOT!!!! So you think the DemocRATs are filibustering judges who insist on going by the law for no reason? DemocRATs have filled the courts with judges who could give a rats _ss about the law. They decide based on what they "feel" the decision should be based on politically correctness.

Havent' you noticed the Supreme Court having to slap the Californis courts often? It's becasue they ignore the **law**.
