Will fire depts need entry warrants ...A completely different question is at issue here. A fire department would be acting in the performance of their mandate if there were a fire. If not, they ought to have a valid reason to be there.

I must assume that this is a part of a single thought. It's hard to tell though, as you are posting like someone not entirely in command of his facilities, but yes, I'd support the premise, that if the cops commit a 'techicality', then an obviously guilty man must go free. It is this very concept that keeps us even marginally safe from massive abuses of power.
The very concept of 'tainted fruit' as it relates to evidenciary (sp?) relavance protects all from the likelihood of 'rogue elements' being able to unjustly railroad people.
It is just that a thousand guilty should go free to protect the innocent from unjust imprisionment.

A very good question. Some here, apparently, do not realize that they can go to the school during normal school hours and arrange for a visit to their children's classrooms when classes are not in session. They can arrange for a meeting with their childrens' teachers, something very few parents ever bother to do.
Of course, if you blast into the administration office accusing everyone of being a commie at the top of your lungs, you're not likely to get too much cooperation, I'd guess. [grin]

I have explained at some schools, they remove questionable materials when they know they are having a visitor, as in the case where I brought a trustee to visit a certain classroom. I mentioned this in an earlier post.

If I am not mistaken, that section is no longer in force. I'll have to research it tomorrow, though.

Not necessarily, unless the beliefs are too bizarre or too radical or too seditious, but attempting to undermine parental authority or proselytizing one's political beliefs or trying to make little mental clones of oneself in the minds of the students would be beyond the pale.
The policeman is not there on a crimes investigation that I am aware of, but as a concerned citizen he has a right to investigate and share any information he finds about the teacher.

The fact that the man who snapped the pictures was a cop is immaterial to the discussion. He is a citizen with rights, too, and as far as I am aware this is not a 'police matter' at all.

The cop stepped over the line here. If he wasn't on official business, he has no more of a right to be in that building at 1:30 in the morning than anybody else.I used to be in the school after hours. It's a public building.

Like your point about "investigation" there was and is no investigation. Why do people keep insisting that there is. Your assuming that this is an abuse of police power. What power did he use to do what? he took pictures of the layout of a class room. That is nothing. To make it into the rebirth of McCarthyism is blowing it way out of proportion.
