Father, daughter who claimed slavery reparations plead innocent

RICHMOND, Va. -- A father and daughter accused of claiming federal tax refunds for more than $1 million as reparations for slavery pleaded innocent to fraud charges Friday.

U.S. District Judge Richard Williams scheduled a July 18 trial for Robert Lee Foster, 51, of Richmond, and Crystal Demetria Foster, 25, of Quinton. Both defendants asked for a jury trial.

Prosecutors claim Robert Foster, a professional tax return preparer, helped people claim fraudulent refunds of between $8,000 and $500,000, the amount of his own claim. Crystal Foster received a refund of $507,490 in October 2001

Good defense strategy. I think the judge will be impressed.

Foster has said his dispute was not with the IRS, but with "racist white rule."

Yes, but the key will be convincing the IRS of this little fact.

According to court documents, Crystal Foster claimed she had overpaid taxes on long-term capital gains in 2000 by $500,000. She listed the fictitious "Black Capital Investments" fund of the U.S. Treasury as the source of the gains.

The article is pretty poorly written. She invented an investment fund, invented some kind of history of Capital Gains and Losses, and then claimed a completely false write-off for $507,490. It's blatant criminal behavior. Really, it would be challenging to be more blatant.

Though I agree the IRS really should look into all half-a-million dollar refunds.

Accidently!? Given all the documentation etc. that I had to provide the IRS, the notion of an "accidental" over-payment of a half of a million dollars is simply risible.

Based on US Supreme Court decision in relation to pilots. It is "belief" that is central, and is a question of fact for jury.

I've been meaning on studying African history to see who the they would owe reparations to. I mean, if we are going to go down that road, wouldn't all of humanity just be exchanging reparation payments? Ultimately, Adam and Eve owe us BIG TIME for eating that apple, doncha know.

Among other things, Malcom X claims that Africans owned white slaves several thousand years ago, and he even reproduces antique Egyptian artwork depicting dark Egyptians whipping some white slaves.

Sort of. She still intentionally misfiled her taxes. If she had claimed on her tax form that they were reparations for slavery rather than making something up it would be a lot more defensible.

Yes, you are correct, but even if it was accidental, do you think the IRS would simply let you go once they discovered their error?

There have been cases where the IRS attempted to prosecute people who had TRIED to return money that they received.

The way the IRS looks at is that you have THEIR money and you are a dishonest son of a bitch and deserve to go to jail for it. Whether you defrauded them or accidentally received it and tried to return it and were not allowed to or that they are just a bunch of dumbasses doesn't matter to them.

The IRS does not even look at returns until two years later. This is for good reason. All returns which result in taxpayer's claims being disallowed such as home office, moving expenses, educational expenses, depreciation, SLAVERY REPARATIONS, become much more expensive after such time has elapsed. Returns that are sent in with payment don't even go to the IRS. They go to the contracted processing private bank where your check is yanked and the return goes into a warehouse for later shipment to the IRS readers, much later.

A $500,000 slavery reparations claim filed in 2001, will become a $600,000 disallowed claim two years later before they even contact you. Where else can the gubmint earn 20% on money owed by waiting and doing nothing? Pretty good deal! Penalties and interest will double an IRS disputed deduction bill after four years.

That particular word from her lawyer was carefully chosen and indicates a strategy to rely on the Cheek case.

The U.S. Census of 1830 showed that 3,775 free Negroes owned 12,760 Negro slaves. A fourth of the free Negro slave masters in South Carolina owned 10 or more slaves; eight owned 30 or more. Two black individuals, Justus Angel and Mistress L. Horry of Colleton District, S.C., each owned 84 slaves, which placed them in the ranks of slave magnates -- those who owned 50 or more slaves.

In Charleston 125 free Negroes owned slaves, representing more than $300,000 in taxable property. In North Carolina 69 free Negroes were slave owners.

William Ellison, a freed slave who lived near Charleston, owned 63 slaves. His sons owned nine more. Ellison's wealth was greater than 90 percent of his white neighbors' and 15 times greater than that the state's average for whites. In the entire state, only 5 percent owned as much real estate as Ellison, and he owned more slaves than 99 percent of the South's slaveholders.

In 1860 at least six blacks in Louisiana owned 65 or more slaves. The largest number, 152 slaves, were owned by a widow Richards and her son P.C. Richards, who owned a large sugar cane plantation. Another Negro slave magnate in Louisiana, with more than 100 slaves, was Antoine Dubuclet, a sugar planter whose estate was valued (in 1860 dollars) at $264,000. That year, the mean wealth of Southern white men was $3,978.

Idiocy is a valuable commodity in civil service. A government worker who operates swiftly, accurately, is detail oriented, documented, and tidy is a ticking bomb. No supervisor, director, or other blood suckers all the way up the food chain will allow that to be. You need a dozen shredders and hard drive magnets for each one employee who is not an idiot.

What makes you think the government wants to employ smart people? Their system is designed to be disfunctional. The poorer the efficiency the greater the need for more funding. They have a disincentive to become efficient.

The exception to this is the military. They die when they function poorly. That is why we need a fighting conflict each ten years. Nobody wants to be lead into a war by officers who only saw pictures of dead soldiers.

That insider angle is accurate. That was about two years ago. Have you ever been inside an IRS processing center? Philly, Atlanta, Kansas City......The employees are about 80% black females wearing slippers. I would think one could find a few employees who would just lose files, transfer them five times, and get a good chuckle out of letting those slip by "mistake".

I used to repair copiers for them. I would find returns all wadded up in document feeders, hundreds of returns behind and under the machine. They were too lazy to even pull the staples before sending them thru the feeders, ripping the attatched supporting forms off and wadding them inside. I learned quickly that nobody would speak to you when you had a 20lb. stack of files looking for a home. I learned to just leave them in a pile in front of the copier with a note. I am sure I know where they went later........

The people who filed these reparations claims I am sure were coached to become zero asset peasants. No home, no car, no investments, etc....before they even filed the scam return.

You can very easily survive the IRS if you are willing to live like a gypsy. The $500,000 is long gone.

A personal bankruptcy cannot defeat the IRS. They take everything. The trick is to have not a single asset in your name. The IRS can put these people in jail and spend another $30,000 per year to keep them there, they can issue levies, judgements, until hell freezes over. It's all racism, bad press, and a big $500,000 hole in which they can keep pouring money down or give up. They will give up. They'll just make up for it by taking some honest persons property instead.

That IS exactly what I mean! That is how it will set a legal precendent! This will open the door to more 'slave reparation' claims. Therefore, if the IRS just gives up versus pouring more money down the legal rabbit hole, it opens the door to more filings. That is how the line of the law is played.

Let me help with the liberal response to this and any other Census or reports indicating Negroes owning slaves = "white racist men were in control of the census-taking and all recording, journalism, etc.

Now, bring on Judge Ito and the proper jury.
