Our dear Maine legislature passed and our Dear Governor signed a watered down version of the kyoto treaty.

This bill requires new sources of greenhouse gases to be
reported to the Department of Environmental Protection. It
also requires the department to create an inventory of
greenhouse gas emissions associated with state-owned
facilities and state-funded programs and to create a plan for
reducing those emissions. The bill also requires the
department to enter into carbon emission reduction agreements
with nonprofit organizations and businesses. Finally, the
bill requires the department to develop a long-term climate
action plan for the State.

Nothing in that nonsense which is outside the power of the State to do. Bad laws are not always unconstitutional ones, unfortunately. Though unconstitutional ones are always bad.

I guess the governor likes to spit against the wind too.
