"...is it not the executive branch that is under discussion, ie, the defense department.?..." True --- but the EO is not a law.
All president Bush has to do is prepare a new EO revising or revoking an EO by a previous President. (This is easily seen by scanning the EOs of various Presidents).

"We have a law on the books that the United States should not be assassinating anybody," he grumbled Tuesday night on Hannity and Colmes.
Poor Charlie ... living in a bipartisan dream world. The abd news for Charlie is that assinations go on all the time by different branches of intelligence. In fact, if they are caught they know up front that the U.S. will claim NO knowledge of their activity. It goes with the job.

Id love to see some of them over there, in their Armani suits and their fake khaki desert-shirts that they love to wear when they are slumming it in a Middle Eastern country God knows why, I guess they think it makes them look less like idiots LOL! The only people around here wearing those shirts and the 'desert vests' are the new reporter and some 'security agents' in from the States. Makes'em stand out in a crowd real well.

(There ought to be a law against excessive legislation.)

It is sad that a decorated Korean War vet like Charlie Rangel has such disregard for our armed forces. He is a disgrace

Once again, another Democrat is rooting for America's enemies. What does that tell you about Democrats?
I don't know. That they are enemies of America maybe?
