Top Silver Aide Michael Boxley Indicted on Rape Charges (updated: August 1st, 5:00pm) A grand jury today indicted top legislative lawyer Michael Boxley on charges he raped a 22-year-old co-worker. Boxley, a top aide for Assembly Speaker Sheldon Silver, has been on unpaid leave since he arrested at the State Capitol in June. The indictment consists of two counts, each of first and third-degree rape. The woman alleged Boxley assaulted her at her apartment after a night of partying at local bars. Boxley has maintained his innocence through his lawyer. Assembly Speaker Sheldon Silver released a statement this afternoon. "I am advised that certain allegations of criminal conduct have been interposed against my counsel J. Michael Boxley. It is inappropriate for me to comment about this matter, other than to say that I have faith in our criminal justice system."

Albany District Attorney Paul Clyne said, "The indictment alleges an act occurred between 1 in the morning and 5 in the morning. There was a second act which occurred between the hours of 5 a.m. and 7 a.m. under similar circumstances, the victim was unable to consent by virtue of being physically helpless."
Boxley faces a maximum of 25 years in prison on the most serious charge.
He is expected to be arraigned at the end of next week. <p

Newspaper reports said Silvers response to the 2003 rape victims plea for justice was to summon state police guards to prevent reporters from questioning the June 10 rape victims boss Assemblyman Susan John (D-Rochester) Apparently Susan John, and/or staffers, and unknown legislators are tightly organized in a RICO-type collusion to cover-up and obstruct justice, and are using police state tactics to protect fellow legislators from possible legal ramifications. These people obviously have something to hide. Innocent people do not need police protection from reporters.
That Silver moonlights for one of the state's leading tort firms -- Weitz & Luxenberg -- speaks for itself. That wouldn't be a conflict of interest would it (snicker)?
Gov. Pataki proposed a comprehensive criminal justice bill with a provision calling for a crackdown on date-rape drugs. But the bill stalled in the Assembly.
The Assembly's pointman on the negotiations? Assembly Speaker Sheldon Silver's chief counsel, J Michael Boxley, who is charged with rape. The victim reported she felt helpless while being raped. Sources have said Boxley, the top aide to Speaker Silver was carrying pills containing a powerful sedative that could have been used as a date-rape drug. Detectives believe the woman was drugged with crushed-up codeine before being raped in her apartment, sources said. The FBI is examining Boxley's computer for this and "other crimes."
The stalled date-rape provision was tucked into a comprehensive criminal justice bill aimed at enhancing the state's Sexual Assault Reform Act. The proposal was announced by the governor April 10 and, with multiple sponsors, introduced in the state Senate April 29.
But the bill has gained no traction in the Assembly and an official familiar with the legislation characterized Boxley as reluctant to get behind bills calling for tougher criminal penalties. "Negotiating any criminal justice bill with (Boxley) has been tough," the official said. Assembly Codes Committee chairman Joseph Lentol (D-Brooklyn) said Boxley had an important role in "every piece of legislation."
Since Boxley is an unelected employee of the state, and Silver determines which bills are posted for vote, one must conclude that Boxley was colluding with his boss Speaker Silver to stall date-rape measures. Boxley and Silver apparently corrupted the lawmaking process to toughen sexual assault penalties in order to protect Boxley from prosecution.
Boxley, the Rapist Rat Uday Hussein wannabe, reports to Slippery Sheldon Silver, a multi-millionaire shyster parasite lamprey sucking the guts out of New York.
How's this for a CLA? White collar crime, misuse of tax funds; abuse of public office; collusion; failure to report a crime; violating the oath of office; possibly receiving illegal gratuities; cover-up; official corruption; filing false documents; misuse of government position; abuse of government power; corrupting the law-making process; use of police state tactics; conflict of interest laws violations; influence buying; conspiracy to defraud; ethical violations by members of the bar; undermining the justice system; possible illegal use of political party funds; possible FEC violations.
And, oh yes, police investigators found bottles of illegal prescription drugs, obtained via the internet, in Boxley's apartment.
BTW, Boxley and Silver are major supporters of a bill to recall the Rockefeller Drug Laws. Say what?

Wouldn't surprise me if Boxley discussed the rape(s) with Silver, giving the Speaker all the gruesome details. Maybe these ardent defenders of a "woman's right to (puke) choose" shared a laugh or two at the victim's expense, as well.

Fred Dicker who, like a butterfly, flitters back and forth across the aisle, ran an excellent editiorial on this story the day following Boxley's arrest.
In that editorial, Dicker expressed amazement at the 'mood' in the NYS Assembly following Boxley's arrest the previous day. They were less concerned about the victim than with the fact that Boxley had been arrested right outside the Assembly Chambers. When the press attempted to speak with Assemblywoman Susan Johns whose intern was the rape victim, the Democratic members of the assembly formed a human chain denying them access.
Those actions, combined with Susan Johns' silence, spoke volumes on this case. The Democrats who claim to speak for "women victims" had suddenly turned silent and threw their support behind Silver.
But, will the voters recall that moment when election time rolls around again? Doubtful!

Police defended the timing of the arrest saying they wanted to prevent Boxley going home to destroy evidence in his computer or in his possession. Police later found pills in the pocket of a jacket Boxley supposedly wore the night of the rape.
If the FBI is on the case, federal crimes were involved. One possibility, Boxley might have gotten the drug from Canada. and the FBI is examining his computer for "other crimes."
I hope the lowlife wrote emails to all the Dumbocrats about his exploits. Would serve them right.
Dicker is the reporter Silver used police state tactics against to prevent Susan John from being interviewed. These two have plenty to hide.
Not that I have any reason to trust prosecutors, and plenty of reasons to distrust them; the reason some prosecutors do not rush to get an indictment and arraignment is because once there is an arrest or arraignment, the speedy trial clock starts ticking. When it is unlikely that the defendant, as in this case, is going to skip town, it is often a wise strategy to wait until all or almost all of the evidence is gathered, Keep in mind that Scott Peterson has not yet been indicted in the death of his wife and child.
