CA: Dean of Students Shuts Down Affirmative Action Bake Sale

Responding to protests by Hispanic and Asian student groups, Dean of Students Sally Peterson shut down a bake sale that criticized affirmative action policies on Thursday, September 25. The bake sale, which the College Republicans at UCI held during the Welcome Week Club Carnival on Ring Road, charged higher prices for white customers.

The bake sale offered Krispy Krème donuts to students at different prices depending on their race or nationality. The prices ranged from $1.00 to $.10 for whites, Asians, Hispanics, blacks, and Native Americans, with the prices varying for each gender within those groups.

Peterson claimed that the bake sale violated the university's anti-discrimination code which states, "the University of California, in accordance with applicable Federal and State law and University policy, does not discriminate on the basis of race, color, national origin, religion, sex, disability, [or] age.this nondiscrimination policy covers admission, access, and treatment in University programs and activities."

According to Peterson, the bake sale falls under "activities" which are prohibited by the UC policy.

Peterson approached Bryan Zuetel, president of the College Republicans, and explained to him that the club was in violation of the nondiscrimination policy.

"First [she] told me this was discrimination and we weren't allowed to charge different prices to different races, she then instructed us to take down the posters and remove the price list," Zuetel said. "I said I was going to call my lawyer and get his opinion on whether or not we could have that price list in place in accordance with our free expression rights. He suggested that we change the prices to be suggested prices. The Dean of Students said we couldn't even sell the donuts at suggested retail prices because it's still discrimination.

"We talked, I told her my position, she told me hers, then we took down the signs with the prices," said Zuetel.

Zuetel defended his club's bake sale.

"The purpose of the affirmative action bake sale is to point out the racial classifications still in use by government institutions, such as universities," he explained.

According to Zuetel, one of the main motivations behind the bake sale is the upcoming October 7 election, during which voters will be asked to vote on a controversial ballot measure known as the Racial Privacy Initiative. The measure, Proposition 54 would prohibit the state from "classifying any individual by race, ethnicity, color or national origin in the operation of public education, public contracting or public employment."

Zuetel's group supports the measure.

"This bake sale showed how certain minorities, i.e. blacks and Hispanics, are required to meet lower standards for university admittance and government jobs than Asians or whites," Zuetel said.

The problems began when Mexican-American College Republican members were challenged for their alliance with the College Republicans by members of the Hispanic student organization MEChA, which stands for Movimiento Estudiantil Chicano de Aztlán.

Eric Roig, the College Republicans' fundraising director, and Francis Barraza, the club's director of freshman outreach, were both harassed by students from MEChA. Barazza believes she was targeted because she is Mexican.

According to Barraza, there was one girl in particular who challenged her: "She was trying to appeal to me based on our common heritage and was trying to say a lot of people like us don't have the same opportunities as white people have."

Barraza said that she was also told, "by saying no to 54 we can continue the programs that target Latinos."

Barraza alleges that she was also called a "coconut," a racial epithet which means "brown on the outside, white on the inside."

In addition to MEChA, the Asian Pacific Students Association (APSA), the Latino Business Students Association, and the fraternity Sigma Alpha Epsilon protested the bake sale. The leaders of MEChA and APSA refused to comment on this story.

The liberals' overreaction is creating more publicity for the anti-affirmative-action folks than the actual sale.

I would never have known about this, except for the news media reports about these strong arm tactics by the libs.

Students at SMU, Dallas, got their bake sale stopped a couple of days ago, too.

There seems to be definite trend against certain kinds of bake sales.

Exactly, Eggsackly. One more point? It's okay for racialists to hold "with federal/state monies" "bake sales" (so to speak, "preferences") for minorities when it comes to college admissions, contracting and hiring... but egads.. Not when it comes to REAL bake sales done by students -- and, not administrators of one-drop rules and segregation.

What Sally Peterson doesn't seem to realize, is that her reasons for prohibiting the bake sale apply equally well to affirmative action, and all other forms of racial preference. That was the point of the bake sale, actually.

Yes, it was. However, those hung up about people of color (which includes every individual on the planet -- no two individuals are alike) -- cannot see, what they will not see. Selective attention - which never gets seen for what it really is: Attention Deficit Disorder.

The students' intent was to underscore unfairness of the AA programs. Their actions constituted illegal trade.

If anything, it amazes me how little of ability to think these students demonstrate.

Forgive me, but you should do a little better. The point I've made was an explanation for shutting down the "busiess." It addressed the role of the university, adn you are talking about something else altogether.

Well, the people being charged the most, white males, did not complain. YOu cannot say that: the total sales were $1.50.

The people being charged the least, females and people of color, were the ones complaining.

They were not complaining about the price but abotu the race-based pricing (public good). All people should've complained about that, regardless of whether they benefit from a particular sale (private good).

The College Republican club is not a "busiess."

It's a just another club on campus, raising awareness of a very political issue.

Raising money for a political club is not a "busiess."

At any rate, the people complaining were not overcharged for the donuts, so there is no harm done to them.

The college administration was wrong on this, and I suspect the College Republican club will outsmart them again in the near future.

The university knew exactly what the intent of the bake sale was. It was not a business, it was a demonstration on par with other examples of "performance art" and thus falls under the umbrella of protected speech.

You are allowing a technicality to override the spirit of the law.

I believe the students behind the bake sale excelled at getting their point across, loud and clear. The liberal California University system is hypocritical regarding affirmative action and anti-first amendment rights.

The leftists operate under a subtle form of terrorism against our republic. When will we say that enough is enough?

Illegal trade? Huh?

Where I live businesses owned by minorities and women automatically get x% shaved off the price of any contracts they bid on by the local gubbermint. So if I bid $125k for a job and they bid $130k and they get a 10% "reduction" for who they are they have the lowest bid and get the job.

While I was engaged in this field I never used subs but I understand that if the primary contractor uses subs they have to do the same thing and that a certain percentage of all sub contracted jobs _have_ to go to the aforementioned minorities.

It's to encourage minority bidness and to compensate for past discrimination ya know (not that I can remember ever discriminating against anyone other than for being an idiot but then maybe that's the "sin" I'm paying for).

As I understand it this is still quite common. I wouldn't know first hand, I won't bid on a government job any longer, I ain't working for no racists...

I wonder if the UC system decided to crack down on these bake sales/AA political protests this school year. UCLA had at least two and UCSD had a least one of these bake sales last year.

At UCLA, there was one person in charge of categorizing an "applicant" and his level of oppression. Maybe instead of giving discounts to the "oppressed," the College Republicans should give discounts to the underrepresented applicants to try to achieve "diversity." Underrepresentation is more flexible.

Maybe you don't understand. "Coconut" is a racial slur against hispanic conservatives, who supposedly "think like white people" and aren't really hispanic because of their non-liberal views.

I agree with you completely. I am not affected by this as directly as you are but I am really appalled by this practice. No "if"s or "but"s here.

But I think that you would agree that nobody can sell for a different price depending on race. Nor would you advocate that, I am sure.
