NYC Churches Shut Out of Public Schools Starting Sunday (70 Churches Evicted)

Although the New York State Senate has passed an amendment that would reverse the New York City Board of Education and Mayor Michael Bloomberg's decision to evict nearly 70 churches from the public school spaces they have been renting, many of them for years, most of these congregations are already packed up and prepared for an exodus as the deadline for departure is this Sunday, Feb. 12.

The state Senate overwhelmingly voted Monday 52-7 in favor of Bill A8800A/S.6087A but the NY State Assembly also has to approve its own version of the bill to successfully block the City and mayor's attempt to evict these congregations, located across all five NYC boroughs, from the public school facilities they have been using as their ministry homes. These public schools, located in Brooklyn, the Bronx, Queens, Staten Island and Manhattan, are used for private services by these small congregations when schools are not in session.

Among the estimated 68 churches now caught in a bind is the Bronx House of Faith, whose challenge of the Board of Education's policy was defeated in June 2011 in the Second Circuit Court of Appeals. The appeals court ruled that the board was allowed to enforce a policy that prohibits public schools from being used for "religious workshop services, or otherwise using a school as a house of worship." While affirming that the Board of Education can, if it chooses, prohibit "worship" at its public schools, the court also decided that churches are allowed to partake in other religious activities, such as prayer meetings and hymn singing. Dissenting lawmakers are apparently concerned about upholding the constitutional call for separation of church and state, with many of them arguing that allowing these Christian congregations to gather is offensive to students of other faiths who attend these schools — although these churches gather when schools are not in session.

According to attorney Jordan Lorence of the Alliance Defense Fund, a legal group that has been at the forefront of this battle for equal access, allowing private groups to gather in public facilities is not a violation of the U.S. Constitution.

"The Supreme Court has addressed this issue at least five times since 1981," Lorence explains on ADF's "Speak Up" website. "When the government opens a building for expression by private groups, it cannot deny access to religious groups. The Supreme Court has explicitly rejected the Establishment Clause as a reason justifying this kind of exclusion, because these are private religious speakers, not endorsed by the government. Government accommodation of private speakers does not mean the government endorses their messages."

Despite state lawmakers on both sides of the aisle agreeing with that argument, some officials have expressed concerns that this particular case involving NYC churches not only shows favoritism to a specific group, but could also open the door for radical or fringe groups to use public schools as meeting places.

Donna Lieberman, Executive Director of the New York Civil Liberties Union, argued during a City Council hearing that lawmakers must fight against these churches for the sake of upholding religious freedom — that the Board of Education would essentially be endorsing one religious group over others if it continued to allow these Christian churches to rent out public school facilities.

Another City Council member, Jessica Lappin, penned a letter before the Feb. 2 hearing expressing outrage that "about 160 New York City schools are doubling as churches." Lappin found it particularly disturbing that these ministries use these public spaces for free or for minimal fees.

"Even worse, some are using taxpayer-subsidized space to preach hatred of homosexuals and people of other faiths," Lappin alleges.

Assembly Speaker Sheldon Silver (D-Manhattan) called the bill passed by the Senate "flawed," and said "it would open up the schools to anybody," including the Ku Klux Klan.

However, Silver has reportedly gone behind closed doors to help improve the language of the bill that would force the City to re-consider its ban on churches meeting in empty public schools. Silver's "improvements" reportedly include language that would appease both the churches and their supporters as well as dissenters. The New York Daily News reports that Silver and his attorneys would provide grounds for civil liberties advocates to later ask a court to carry out the evictions.

As the legal wrangling in Albany continues, these uprooted churches are faced with the immediate worry of where they will be worshiping next, because although the state Assembly could very well vote in their favor, observers say such a result is not likely to come for months.

While other congregations with established homes have opened their doors to these ministries, some of these churches are still finding it difficult to simply pack up and leave the neighborhoods they have called home, and sever the precious relationships they have fostered with the schools and local residents.

The Rev. Jon Storck, who leads Grace Fellowship Church in Queens, has been holding services at Public School 150 for more than five years. Storck shared with the New York Daily News that he fears being uprooted from the community would mean a loss of more than half of his congregation, which has only found a temporary home for the next two months.

Many of NYC's Christians have banned together to push back against what they view as religious persecution that could very well affect churches across the nation. According to Lorence of the Alliance Defense Fund, no other cities have enacted a ban like the one NYC Chancellor of Education Dennis Wolcott has put forth, and no city has been sued for violating the First Amendment.

Tim Keller, pastor of Redeemer Presbyterian Church in Manhattan, has spoken out against the City's decision to evict these nearly 70 churches, as several of the ministries being put out of their homes have ties to Redeemer Presbyterian. In an op-ed published Tuesday, Keller called the City's decision "unwise" and expressed his conviction that forcing many of these churches to uproot from the neighborhoods they have been in for years, will prove detrimental to those communities.

MSNBC journalist Martin Bashir, who reportedly worships at Redeemer Presbyterian Church, has used his prominent position on his daily news program to advocate for these churches' rights to equal access. On the program's Wednesday broadcast, Bashir called on Mayor Michael Bloomberg to reverse his decision to ban churches from public schools and to show religious tolerance.

The New York City Housing Authority (NYCHA), perhaps taking a cue from the Board of Education, made a similar move, refusing to renew month-to-month leases with several congregations that use its community centers, as meeting places for their ministries.

Pastor Dimas Salaberrios of Infinity NY Church, which meets at a NYCHA-owned Bronx River Community Center, decided to push back, eventually convincing the housing authority to relent.

Salaberrios, who has rallied with the affected and their supporters outside of the New York City Law offices and elsewhere throughout New York City, believes the Board of Education's policy disproportionately affects the poor.

"If something does not change, our city will face the result of carelessly displacing thousands of people from their churches. Furthermore, even secular New Yorkers will suffer as our poor lose their social support network. Who will be crying and weeping with them?" Salaberriors said in an online post.

According to a poll published Feb. 2 by LifeWay Research, about 65 percent of Americans do not mind churches using public school spaces for worship, while nearly half of all New Yorkers agree with that statement.

An Equal Access web page has been launched for local churches in need of a meeting place and for congregations that are able to offer them space. By visiting the NYC Equal Access page at faithstreet.com, "helpful" churches can coordinate with "homeless" churches for worship space. As of Saturday, there were about 33 evicted churches listed as "homeless" and in need of space.

On a radio program Friday, Mayor Bloomberg showed no sign he intended to interfere with the Board of Education's decision to oust churches from public schools. He, in fact, lauded the policy, insisting the policy is in favor of religious freedom.

"Separation of church and state is one of the basics of our country, it's one of the things that keeps everybody having the ability to pray how they want to pray, or not pray if that's what they choose," Bloomberg told WOR radio.

As for lawmakers in Albany attempting to hammer out a solution to the equal access debate, Bloomberg said, "I don't know what's going to happen in Albany. I can just tell you what's happening here. This is the last Sunday that these religious organizations will be able to have worship services in the schools."

Bloomberg continues his crusade against Christianity that we saw him promote by refusing to have prayers at the 9=11 memorial service. He is for the nanny state becoming the new god of the people by all of the restrictions he has promoted during his 3 term dictatorial reign. but the nyc sheeple are too dumb to know that freedom is better.

“Separation of church and state is one of the basics of our country”-—it is a lie. It is in Stalin’s constitution-—those words don’t exist in our Constitution.

Besides-—mentioning God is NEVER an establishment of religion-—or an endorsement of an establishment of religion-—it is freedom of religion.

For all our tradition-—until this faux term was introduced by Marxists-—Even Jefferson allowed churches in the White House to form religious services.

What these guys are doing is creating no freedom of religion. They are trying to erase the Christian God from our government-—to replace it with what????? Shariah law????? Secular Humanism??? Atheism??? Paganism???? If they kick out God they force another worldview-—none is suitable for our Constitution-—except the Judeo-Christian God-—because our Natural Rights come from God. That makes it too important of a concept to banish.

This Atheist priest and our courts are trying to banish God and by doing so WILL banish our Natural Rights and freedoms.

I can’t stand Bloomberg.
After the bell rings a school becomes just another empty building bought by and maintained with tax dollars. I would think they would like to have the extra revenue from the rental fees.

Bloomberg, born Jewish, has no enthusiasm for Judaism or the Jewish community. He’s give millions to charities, but I have heard of no donations to Jewish charities.

He specially selects Christians for harassment and official oppression while permiting muslims to build a victory mosque at ground zero. He is movitated by something in his character make up. One more thing. If this were a Christian Mayor harassing Jews like this, Christian conservatives would tell him to F off and not make excuses and rationalization for him. “Oh, he’s not really a Christian.”

Christian and Jewish conservative support should not be a one way street; it should be mutual and that is the only way to overcome leftists. A one way street will lead to a no way street. Think of how much good will Jewish conservatives would have gained among Christians had they stood up to the bigot instead of making excuses for the bigot Bloomberg.

In the state of Tennessee a Presbyterian Pastor started the first school in Tennessee.

Who has built hospitals, orphanages, Colleges, and Universities in our nation?

The church I go to is directly involved with the local middle schools and runs several of their sport’s teams (basketball, soccer, wrestling, ...). Also have mentors to just hang out at lunch and in the halls. And tudering. It is catching on big with more churches and schools joining every year in a joint effort to help the kids.

Of course one can’t specifically mention Jesus or God - but the kid’s understand that is what is driving it. It was pretty amazing the turn-around at a couple of the schools where it got started - and for the entire school! (The comparison grades things went from failing to a “B” or something).

And then some offshoots where the church will find out about individual families needing help, and in some cases have turned into on-going Bible studies with those families, etc.

Time to prepare your minds for some severe persecution. Read any books you can of the persecution of Christians in Communist countries. The time of ‘freedom’ is coming to an end. And, in view of the last 2,000 years, religious freedom has not been the norm.

Good idea. Instead of law-abiding, quiet, religious groups using these buildings on the weekend & generating revenue for the City of New York too, leave the buildings deserted to be broken into and vandalized by the local “youth”.

Bloomberg is our most prominent Bolshevik commissar in the Northeast, truly an enemy of God. On a positive note, many of these “churches” are more like political action committees for Democrats; the Commissar wants to shut down left-wing groups as well as those of the right.
