Canon Law and Fraudulent Marriages
Canon Law Made Easy ^ | March 20, 2014 | Cathy Caridi, J.C.L.

Q: My fiancée and I attended a marriage-prep class in our diocese, and one of the speakers said something we didn’t fully understand. First he urged us to be open and honest with each other about our past lives, not hiding anything from one another, which made basic sense to us. But then he mentioned that we need to do this because otherwise our marriage could be null.

We’ve known each other since childhood anyway, so it’s a moot point for us. Later on, though, we were wondering if telling your future spouse every single little thing about you is really necessary for a valid Catholic marriage? What happens if you honestly forget to mention something? –Scott

THANK YOU, this has blessed me beyond what you can imagine. We never really hear about annulments anymore.

And note also that for a marriage to be found null under this particular canon, the one spouse must have deliberately deceived the other, by consciously hiding/distorting some aspect of his life which, if known, the other spouse would presumably object to.

I knew someone who was a 10K a night party girl in Europe. She also married (for a lucrative sum) in a civil ceremony a wealthy UK homosexual who wanted US Citizenship.

At age thirty, pretty much the end of the line for 10K a nite party girls, she married a Catholic businessman. From time to time, she would get $$$ from former high profile clients who wanted to insure she kept her yap shut about their former relationships. She would tell her husband the $$$ were from relatives

It made for interesting testimony at the marrieage tibunal when she wanted to divorce her husband, and have the marriage annulled. He was totally blindsided when her former life came to light.

Yeah, the party girls usually want out.

I have a family member who’s ex (40+ years ago) did the “I’m pregnant and it’s your baby, confirmed by my doctor, need $ for abortion” routine. His family had wealth, surprisingly </s>.

Young man wouldn’t hear of killing the child, offered to marry. “Love child” was born nine months and two weeks later, she got real lucky. Based on that, we surmise she was on her menses when she announced her “condition.”

It lasted seventeen years, she wanted out when she became certain she’d bettered her deal. They never busted her though, for the sake of the child that was (ultimately) born.
