The local Christian rock band PAWN is taking it's fight about the separation of Church and State to court. Just a few months ago PAWN was told they were not allowed to play at Rossford High School, and now they're fighting the decision with a lawsuit. However, to prove this lawsuit is not about money, members of PAWN are suing the Rossford school district for only $1.
The band's lawyer Thomas Condit says they didn't want to take the problem to the court or sue their school, but they had no choice.
He says after promoting the concert, their anti-drinking, anti-drug performance at Rossford was cancelled with little notice simply because they have a Christian viewpoint, which is a clear violation of their first amendment rights.
Although they've written many of their own songs, many of them with Christian lyrics, they were not going to perform those at this concert so the cancellation of pawn was perplexing then and it's perplexing now, says Condit.
So what does the band hope to gain from this lawsuit?? They say they hope to get the message across that regardless of their views, they have the same rights as anyone else.
No word yet on a court date and right now the Rossford School District has yet to release any comment or official statement on the lawsuit.
Should have named their band "Satan's Children" then they would have played.
Or they could have said they were going to do a demonstration of fisting. They probably could have gotten paid by the NEA.
Yeah, or Gay Pawn. They would have been sent school to school to play. It is pathetic how twisted the first amendment has become in this country.
School board settles for $1 case closed. Or can the plaintiff refuse settlement and demand a court trial?
The school's problem is that this qualifies as a civil rights lawsuit. If the plaintiffs substantially prevail, the school is stuck for their costs and attorney fees.
I believe they can refuse settlement in that they are probably going to request lawyers fees be covered as well. I am not sure how much their lawyer is going to charge, but it could be somewhat expensive. The schools decision was really pathetic. I live in the school district that made the decision (Rossford), and there weren't even any comlaints about the Band's scheduled performance from what I gathered. I do not see why schools can't just put a disclaimer before they allow religious type speech at commencement ceremony or something similar. All they would have to do is say - the views of the following speaker do not reflect the views of the school and are not intended as an endorsement of said views.
Yes I know that according to lawyers, if it is a law, it cannot be illegal.
kind of a stupid idea if you really think of that statement - but that is how they think.

Perhaps if they got Ward Churchill to sing backup they would have an easier time.

Satanism good; Christianity bad
Islam good; Christianity bad
Homosexuality good; morality bad
Promiscuity good; abstinence bad
I'm sure there is more, but I can't think. My head is spinning!
