Papers Implicate Calif.'s Gov. Davis

SACRAMENTO, Calif. (AP) - A federal judge ordered the release Monday of documents from a decade-old fraud and racketeering case in which a convicted felon implicated Gov. Gray Davis (news - web sites) in a bribery scheme.

The release comes a week before voters go to the polls to choose between Davis and Republican Bill Simon, who has made attacks on the governor's fund-raising practices a centerpiece of his campaign.

Former Coastal Commissioner Mark Nathanson named Davis, then state controller, in two letters he submitted to prosecutors in 1993 as part of an unsuccessful attempt to cut a more favorable deal after pleading guilty to racketeering, tax fraud and soliciting bribes.

He was sentenced to four years and nine months in prison and fined $200,000. Prosecutors said Nathanson solicited money from celebrities and others in exchange for help getting projects approved by the powerful commission.

The Sacramento Bee has sought full release of the letters for two years. Until now they have been released only in censored form. The U.S. Supreme Court (news - web sites) cleared the way for the release three weeks ago when they refused to hear an appeal.

Nathanson claimed he recalled "a number of instances where Gray Davis approached Mr. Nathanson, who was then a member of the California Coastal Commission, to assist various friends or supporters of Davis who had matters pending before the coastal commission," according to a 1999 letter that was unsealed Monday by U.S. District Judge Lawrence Karlton.

Davis spokesman Roger Salazar said: "These are baseless charges made by a man who is a convicted felon, admitted perjurer ... in an attempt to get his sentence reduced."

Prosecutors rebuffed Nathanson's allegations at the time, calling him a liar.

Still, Simon kept up the attacks Monday up at a Malibu press conference.

"These are very serious allegations and yes, of course, we need to consider the source, but one should also consider the well-documented record of Davis' pay-to-play politics," Simon said.

Earlier this month, Simon accused Davis of illegally taking a campaign check in the state Capitol. He was forced to retract the claim when the photo he was using as evidence turned out to have been taken at a home.

Simon has contended Davis is worried about the contents of Nathanson's letters, citing as evidence a letter Davis attorneys sent to all major TV stations in California last week warning them not to run any Simon ad based on Nathanson's allegations.

Simon aides said there was no such ad.

As I said earlier today, the Davis campaign has not had any problem airing ads about a lawsuit waged by a convicted drug dealer against Simon(which was overturned) but when it comes to a convicted felon making accusations against the Davis campaign "oh you cannot believe what a convicted felon says"...the Dems are so hypocritical and transparent it is pitiful...

How can Davis cause Simon to not run slots with this information.

This is really funny. Are the papers to be released today or did the judge just issue an order today requireing them to be released at some unspecified time. If he just issued an order to release them today, and did not set a date and time for their release they may comply with the order the day after the election or December 11th whichever comes last. It is interesting that this order comes 3 weeks after the Supreme's decided not to hear the case. Things do move slowly.

It would seem to me that the order issued would have to have a date and time by which the release must be done or it is worthless. This story does not say. It only says an order is issued. Do they have 10 working days to comply? That is the usual circumstance.

   comply with the release order using all the dispatch at 
   our  command. However, our copy machine broke and it 
   won't be fixed before Nov.12. In order to comply as 
   rapidly as possibile we have sent the said documents  to 
   a copy firm with a rush order statement attached. The
   Firm (Davis Printers Inc) say they can have them copied 
   by Nov. 8th. We will release them the instant we receive 
   them.

From what we have heard recently, Davis is STILL taking bribes . . . er, campaign contributions . . . for influencing the Coastal Commission. The Sierra Club has been whining about it, although of course they will continue to support the Democrat, no matter what he does.

Excellent point. You are right, this was a federal case, and the AG was Janet Reno. No wonder they did not want to look into the allegations.... democrats protecting themselves.

Thanks for the clarification. Dan Lungren had nothing to do with this case.
