California recall petition is being illegally delayed.

California's Secretary of State, Kevin Shelly, is attempting to delay the counting of the recall petition signatures. This move is clearly illegal and a violation of Shelly's sworn duties as an elected official.

You can e-mail Kevin Shelly at kshelly.ss.ca.gov to demand that he stop his illegal delaying tactics.

Isn't it time for Ashcroft to be called. When a states' AG and SOS flout the law in defense of the states' executive, its time for the Feds.

The recall backers are giving Shelley until close of business Monday to knock this off. If he doesn't, they sue on Tuesday in a Sacramento court that's geared toward handling these kind of election-type disputes expeditiously. But this whole thing is further evidence that this state government is just plain effing out of control.

I don't know if the answering machine was on because Shelly's staff are cowards or because, being state workers, they go home early on Fridays.

Send an e-mail. It will be waiting for them on Monday.

Speaking of John and Ken, a couple of days ago they detailed a tidbit in Los Angeles Magazine's Buzz section or some such name that is a gossip column.

Apparently Davis, on Saturday afternoons, visits a Saks of Beverly Hills, having the employees keep the store open after regular business hours for him so he can "shop".

According to a store manager, Davis spends most of his time (2-3 hours) in the men's shoe dept. but, get this......never buys a thing.

WTF is up ith that?

We knew this jerk would do this!
The rats don't have the least respect for the laws, and get away with it over and over.
We need to get them all out of our government in California and take this state back!

Some months ago, J&K had a segment where they invited people who had weirdo stories about Davis to call in. A number of them did, relating their tales of oddball behavior. One guy said he lived in the same buildig as Davis for a while, and one day he was in the elevator when Davis got on. Davis asked him to step off the elevator, which he did, thinking that there was something wrong. Davis said "thank you," punched the button and went on down. The guy is from another planet.

There are a lot of rumors about Davis and his extremely odd behaviors. It is reported that he eats the same food everyday, that he is extremely rigid in his personal habits, and that he has verbally and physically abused his staff members.

I can't confirm the rumors. I just know that they never seem to die.

Shelley slows the recall count

Big news from the Secretary of State’s office on the recall. According to a spokesman, Secretary of State Kevin Shelley has interpreted the law to say that county registrars need only be verifying the signatures they received by June 16. The rest they may set aside until the end of the next reporting period on July 23. Then they will report that number to Shelley and he will give them the go-ahead to verify the second batch. But they won’t be required to report that new number until Aug. 22. If this ruling stands, it will delay considerably the verification process and the date by which the recall qualifies for the ballot. It would almost certainly delay the election until March.

This is looking more like a mirror image of Florida every day. Instead of a Republican Secretary of State fighting to slow a recount and elect a Republican president, we have a Democratic Secretary of State acting to slow a signature count to prevent the recall of a Democratic governor.

And just like in Florida, this one might also wind up in the courts. Except for one problem: if the recall proponents sue, they might find themselves locked in a legal death struggle that could delay rather than quicken the pace of the count. So they may be trapped into accepting Shelley's edict.

My reading of the elections code is that the counties are supposed to be verifying the signatures as they get them. Here’s what it says:

11104. (a) The elections official, 30 days after a recall has been
initiated and every 30 days thereafter, or more frequently at the
discretion of the elections official, shall report to the Secretary
of State all of the following:
(1) The number of signatures submitted on the recall petition
sections for the period ending five days previously, excluding
Saturdays, Sundays, and holidays.
(2) The cumulative total of all signatures received since the time
the recall was initiated and through the period ending five days
previously, excluding Saturdays, Sundays, and holidays.
(3) The number of valid signatures, verified pursuant to
subdivision (b), submitted during the previous reporting period, and
of valid signatures verified during the current reporting period.
(4) The cumulative total of all valid signatures received since
the time the recall was initiated and ending five days previously,
excluding Saturdays, Sundays, and holidays.


Those last five lines seem pretty clear: the registrars are required to notify Shelley on July 23 of the number of valid signatures received during the current reporting period, and the cumulative total. And that would be as of July 16, when the recall organizers say they intend to have submitted all the signatures they will need.

But Shelley’s spokesman says that’s not the case.

“They’re required to provide us the number of verified signatures received through June 16, for the next reporting period (on July 16),” the spokesman said. “If they want to verify signatures received after June 16th, the law does not address that issue. They’re not required to do so.”

The problem is that the statute on signature verification seems to clearly require a continuous verification process, but the detailed rules for the process itself (elections code section 9030) are the same as for a ballot initiative, where the signatures are normally turned in all in one batch. That conflict is what gives Shelley the opening he appears to be exploting to delay the count.

Are you sure of the e-mail address? The Sec. of State website gives e-mail addresses w/a "@" before the ss, but I still couldn't get the one given to work. Anybody know the correct e-mail address? Here's what I'm sending if I can get the address:

Dear Sir: I have not had the chance to review the facts behind the allegations that your office is illegally delaying the count of the Davis recall petition. However, it's clear that sufficient voters support the recall, and that your office should move expeditiously to count the signatures and move the issue toward a new election.
Please count the petition signatures as soon as possible so the election may be held as soon as possible and the wishes of the voters carried out. Thank you.

But if there are discrepancies in the count you all should be emailing AG Ashcroft so the feds can step in for the count. Off to bed. Early rise tomorrow.
