Geraldo Rivera appeared on Fox & Friends on Friday where he praised the Supreme Court decision on Thursday that allowed President Barack Obamas health care reform law to stand. However, he said that the decision would lead to a Republican victory in November as Democrats would now have to defend the law as a tax increase. It is a political issue and now the Republicans can make 2010 happen again, reenergize the tea parties, get the base motivated and bring the Obama tenure to an end, said Rivera.
Rivera called Chief Justice John Roberts decision brilliant and said that, in the wake of the Citizens United ruling in 2010, his court was getting a reputation for being reliably conservative.
He achieved a result that absolutely blew that out of the water, said Rivera. Nobody now is talking about the political court. Chief Justice Roberts, one of whose prime roles is protecting the court scores big time he protects the court.
Rivera said that by upholding the law on the narrowest of grounds and reframing the mandate as a tax, Republicans have been handed a political opportunity.
He has gifted President Obama a poison pill, said Rivera. Republicans now can remember, unless something is done, that the Bush tax cuts also lapse at the end of the year. So here you have the largest tax increase and the increase coming from the expiration of the Bush tax cuts he taxed us, he said he wouldnt tax us, he taxed us. I think the Obama presidency hangs by a threat right now.
I dont mean to demean the Chief Judges integrity in any way, said Rivera. He said that Roberts may believe his opinion but the result is an incredible shift towards Republicans.
It is a political issue and now the Republicans can make 2010 happen again, reenergize the tea parties, get the base motivated and bring the Obama tenure to an end, said Rivera.

I think he's right about the Republicans winning big in November, but his praise of the court and Roberts is asinine (as usual).
My God. I agree with Jerry Rivers.
*Gun to temple*
....BLAM!
Wrong. No meaningful number of voters is going to suddenly say, "Justice Roberts upheld it as a tax instead of a fine? Well now I'm against it, I didn't know it was a tax!"
And the MSM or Jay Leno or Jon Stewart or wherever it is the average person gets his or her info from isn't going to dwell on this "is it a tax or a penalty" business.
It's true the fact that the Court did not strike it down will motivate people who are already against ObamaCare to work to elect people who will repeal it.
But the characterization of the individual mandate as a tax or a penalty will have virtually nothing to do with how the masses vote.
Whorealdo is trying to paint Roberts as clever because he gave the liberals what they wanted, which is not striking down the law. The liberals don't really care why he did what he did and it will never get filtered out to the masses anyway.
Well, that depends on whether Romney takes advantage of the opportunity he's been handed. Romney can press Obama on whether the I.R.S. has enforcement capability. Obama's screwed either way he answers. If Obama says the I.R.S. has the power to go after people for not buying insurance or paying the tax penalty, voters won't like that. And if Obama says the I.R.S. can't enforce the tax penalty, he's gonna have to explain how he'll make up for the missed revenue from people who refuse to pay. John Roberts made a horrible ruling, but he did give Romney a golden political opportunity.
In the end ObamaCare was about money. The political class is drooling over the windfall of revenue that’s about head their way.
Absurd. This has energized both bases. You think 29 million Obama voters that sat out 2010 will sit out again? Folly. We’ve been sold a bill of goods by the GOP overlords.
Ignore pundits.
>> Is he right?
Seriously, 2DV, do you really expect the ideologues to show up for the Romney election?
Hopefully states will start seceding soon to form a free country.
I rarely agree with Whorealdo. This time I do. I am more motivated than ever to beat Obamugabe and elect a Republican senate.
A tax, remember, can be rescinded with a 51 vote majority, and since it has to do with the budget, it CANNOT be filibustered....IF we elect a majority Republican government, Obamugabe Care is as dead as Saul Alinsky.
This is what Obama will do: ask Congress to “suspend” the tax for low income people (e.g., the 48% who already don’t pay taxes). He will make it a class warfare issue.
Whether or not Roberts did this as a RINO or a brilliant strategist is irrelevant.
The fact is, the issue now is: the biggest tax increase in the history of the world.
I only hope the Republicans are smart enough to run with that.
Now there is something I can agree with.
So we have to vote for a Democrat to save us forma Commie. So energized I could just *$*&(.
I agree with him. IT makes things clear. The decision pulls the wool away and tells it like it is. The democrats tried to pull a fast one on us. April 15th every year you’d be hit with a bill for health insurance.
In a sane world.
Of course, in a sane world, this atrocity wouild have never been enacted, much less propped up with SCOTUS "activism".
Unless the GOP gets decent ads out showing the facts especially that Obamacare effects don’t really hit until 2014 the American public will forget about this by November
Romney, the RNC, or somebody needs to start running a series of “Obama in His Own Words” commercials. Obamacare is not a tax, close Gitmo, try KSM in New York, don’t raise debt ceiling, I will cut deficit in half in my first term, etc....
