That depends on whether you believe in the 10th amendment. Powers reserved to the states or the People. In this case the people. (ballot initiative)If the Supreme Court's unconstitutional imposition of "gay" "marriage" on the entire country is a violation of the 10th Amendment - and it certainly is - then how could Congress' unconstitutional imposition of a marijuana ban on the entire country be anything but a violation of the 10th Amendment?
