Maybe Pres. Bush will ultimately tell the justices to take their army and go free them themselves!

(What they should have done w Roe V. Wade, bitch slap the court down and refuse to obide by the unconstititonal decision).

How does the 9th circuit even have jurisdiction to make a ruling in this case... the detainees are in Cuba, which isn't in the 9th circuit.

Hmmmmmmmm, the most overturned circuit court in the nation. On to the Supreme Court then. Even they don't inspire a hell of a lot of confidence. Indeed the Supremes are getting as bad as the 9th for stupidity.

God save us from activist judges.

The 9th Circuit Court is REALLY showing how useless it is.

These rulings are disgusting, they really are. The FRIGGIN Japanese, Germans, North Koreans, North Vietnamese, and VC were NOT given access to American Courts and American lawyers!!
Why the hell is this SINGLE Court RUINING this country SINGLEHANDEDLY???

This would not be an issue if they had not been detained on US soil. Once they were transported to US soil (GITMO qualifies) they are afforded due-process protections of the Constitution.

Had the military set up a holding area in Afghanistan or some other country we wouldn't have this issue.

The case was filed in the 9th Circuit just because of the judges. I suspect they first will ask for an en banc review, and it may be reversed at that level. Otherwise, it will go to the Supreme Court.

Since these guys are in Cuba and are not Americans, Bush could just tell the court to stuff it, and let it try to enforce its ruling. Too bad he won't. I forget which President when told of a particular court's ruling questioned just how they intended to enforce their ruling as he had no intention of acknowledging it.
